The Lender is requesting me to "update" a refi appraisal done a month ago ...I must admit that I am drawing a blank on weather this would be considered a new assignment or just an update of the original refi report.
All appraisal or appraisal review updates, by definition, are new assignments.
The rest of your concerns are SOW issues as well as the business decision of what to charge.
Something stinks. First you are finding that when you did it as a refi they didn’t tell you there was a contract to sell. Or, more than likely, they didn’t and they drew up a contract with a date of before the original appraisal. In either case, they are willingly trying to deceive you.
Now they want it fast and for free, thinking that if you are not being paid you will just buzz through it with your eyes closed. How good of a client is this?
just out of curiosity... what did the borrower for the refi say when you asked them if the subject had been for sale in the preceding 12 months? we already know it was based on what you posted about the contract date, so i'm curious what their response was when you asked them.
