USPAP 2010 disclosure, confidentiality

If you decline an assignment because you have an agreement not to disclose a prior assignment then you would have to disclose that which would violate the agreement.

What are you going to do? Play mind games with a client who just wants an appraisal?

Client: We need an appraisal of this property.
Appraiser: I have to decline to accept this assignment.
Client: Why?
Appraiser: I can't tell you.
Client: What do you mean you can't tell me?
Appraiser: I can't tell you that either.
Client: You mean you don't want to do this appraisal?
Appraiser: No. I want to do it. I need the work.
Client: Then why can't you do it?
Appraiser: I can't say.
Client: You little @###$@!% I don't have time for this. click
Appraiser: *crying*

How many times a day do you have this conversation?

This is an exceptional occurrence that may happen but not very often though, and the USPAP has offered the solution: decline.
You got two USPAP rules conflicting each other. You cannot comply with both at the same time. complying with one is the violation of the other.
 
Greg have yo been appraising properties with that kind of vegetation again?

If your past client and you did not have an agreement for you to NEVER disclose the mere fact that you appraised the property (and, such would be very rare, I have to imagine, if you've been appraising for residential lending use), there is no "confidential" information to divulge

Don't know about the rest of you but in 30 years of appraisal related experience I have NEVER had an order that specifically stated in the SOW that I could NOT DISCLOSE to anyone that I appraised the subject in question.

How many times do you REALLY think this will happen? Notta

I agrre. Simply disclosing the fact that you have appraised a property in the past 3 years does not violate confidentiality. USPAP has allowed such for years, even giving advice on how to redact confidential information. I will be glad when every one gets busy enough again that such trivial matters will not be the subject of long discussions.
 
If anyone is concerned with this, the answer is very simple. Either refuse any client agreement that requires you to never disclose you have appraised the real estate to anyone else.... or tell such a client asking for such an agreement that they are going to pay you two to three times your normal fee for all the future bookkeeping needed to keep track of their stupid agreement and the real estate involved with their stupid agreement for the next three years.

So simple, just don't agree to that with anyone at all.
