VA input request re: missing porch railing

I don't do VA. But, isn't any safety issue a VA MPR issue?

Pretty much, although there may be individual exceptions that I am not aware of. My point is, not every VA MPR issue corresponds to a code violation issue. And, not every MPR issue has to do with safety.
 
My point is: don't go into specifics, unless you go into all specifics. You tell them to put up a railing that is 30" high, they put up a railing like one of the above that complies with your request, a kid falls over, you get your azz sued. They did what you requested and look what happened.

Request that it is built to code. You're not a building inspector or contractor, so if the client wants verification of code compliance, they'll need to higher someone qualified. Here's a photo, Mr Client. It appears to meet MPR. The ball's in your court if you want verification.

Anything that I call for "subject to" is to code. I'm not going to suggest that they do it to partial code. nope...not gonna do it. Good luck to the appraisers that take that route.

It would be available through the VA Regional office that covers that area. But, I doubt they would provide you with a list.

I believe FHA requires the height AND spacing of supports. They used to say that a baby's head should not be able to pass between the rails. I agree that the more generic you make the requirement, the less liability you may accrue

If I state that it has to meet VA MPR's and quote the VA statement, then if they decide to file suit I suppose they could sue VA or the lender.(Good luck with that) I am doing as VA requires me to do.

It is up to the property owner to comply with building codes, or the person they hire to construct, in this case, hand rails. I am not an enforcer of building codes. I take a photo of what they have done and submit to lender. If building codes apply then the lender needs to assure compliance.
 
The VA is not specific on this. Compliance to applicable current buidling codes only applies to proposed/under construction. For existing dwellings, it must be "safe, structurally sound, and sanitary and meet the standards considered acceptable in a permanent home in its locailty". (ch.12, very first page) The VA expects that you, as an expert in your field and your market area, to exercise judgement in determining if the dwelling meets this criteria.

If they want specifics on what is considered acceptable, I would refer them to alternative guidelines such as HUD or the local building codes, but it is not required, by the VA, to comply with these guidelines; only that it meet the above criteria.
 
Thoughts on this for VA and/or FHA...
