Water Front vs Water View

Just completed an assignment for a "water front" home.

Pulled the tax records and plat only to find that it isn't exactly waterfront at all. That is, if you walk out the back door and toward the water, you will have to step on the neighbor's land prior to wading in the river. The subject has absolutely zero actual frontage. Nice view, but no front feet.

Needless to say I was surprised to find that the previous listing actually described the house as waterfront.

I decided to call up the old listing agent. She said she recalled the property, and indeed, it WAS waterfront. From there I called the current listing agent and asked him the same thing. IN fact, I asked him, "Hey, is this home waterFRONT or waterVIEW? To which he responded "Waterfront!"

The buyer's own agent provided a CMA in which she held up more than a half dozen waterfront comps going head to head with the subject--with absolutely no mention or adjustments.

Amazing.

How is it that agents can list a property as having something it does not?

It's a misrepresentation so offensive that it almost doesn't even matter the intent.

If anyone is wondering what the difference between Waterfront and only a water view mean in terms of dollars, it comes down to minimum of about 20%. There are cases in the same market area where that difference is as high as 50%.
 
Realtards do not understand what happens when the big row of hedges is installed and starts growing or those bamboo palms grow up on adjoining properties that the subject is no longer "water frontage"

At the two large hydro lakes in my market, the difference in land value would be a lot more than the mentioned 50%. Imagine that the adjacent property owner built a structure between the subject and the lake. There goes the perception of waterfront.
 
Who cares what the REALTORS® say...report what you know.

That's what I was thinking. It's no different from Skippy, the form filling residential appraiser, calling it waterfront without verifying.

I guess my question is, what is the action to take?

If the appraiser did this, it's a no-brainer. And it doesn't matter if it was intentional or not. The appraiser certifies that he will not make a mistake or series of mistakes that leads to results turning out not to be credible.

But the real estate agent--what obligation is he under? Won't he just say, "But I didn't know! It sure looked like waterfront to me!" ?

To what body do you turn in his listing or cma?

And since no one has settled on this property, what are the damages anyway? No one was burned as a result of their misrepresentation--be it from dishonesty or stupidity.
 
I OWNED a waterfront property and it was valued at about $100k more than water view.....even though it was in a slough where water vacated in the 'HOT' months, it was still a waterfront. We used to call it a 'frog front' (lol) due to all the frogs croaking at night when the water left.

At least there were deer that came to the feeder I put out when it was dry, so always something to drink coffee over in the mornings!

Back to the OP.....THAT is why WE are APPRAISERS and NOT Realtors......we KNOW the information correctly. Let them try to sell it as a waterfront and see how much they get sued for false advertisement....(lol)...THEY DESERVE IT if that is what they are doing!

I even had a lady (posted earlier this year) that argued with me (Divorce appraisal) that her property was a waterfront....only thing she forgot was that the Corp of Engineers OWNED ALL THE PROPERTY surrounding the lake......hence, NO waterfront for you!
