Spent an interesting day on the phone.

First with the Dept of Regulation and Licensing, Appraisers division for the State of Wisconsin. They listen to me about the lender that was asking me to reach value, sending me orders and telling to call if I got out there and I thought the subject would not bring value. Having been sent 14 orders and been paid for four of them.

About the call last Thurs that threatens to turn me in because I would not refund a clients money, because I could not reach value he needed. There for I took his money with out giving him “a product that was of any value”. That I was committing fraud by doing this and should have my license pulled. Any way they listen to my problems. Then they said there was nothing they could about the lender or the borrower. They only covered what the appraiser was doing.

So they referred me to the State agency that handles Bankers and Lenders. They listen to my story. Told them I had the tape of the call. End results was sorry, we can’t do anything about it. They can say you faked the tape and are lying about what you are saying. I told them I even had all the orders where they wanted me to get value. Where when I did not make value, they had used other appraiser, who jump out 2 to 3 miles to find comps. When my seven were in the same area as the subject. Still said there was nothing they could do.

I set in CE Class all day on Thur and Fri. Listen to all the updates for USPAP. Heard other appraisers complain about lenders and appraiser not following USPAP. Whats right and whats is not right. How you “should be doing it” correctly.

But if the State or the Feds don’t have any teeth in there bark or a large number of other appraisers are not going to bite the lenders in the butt and make them tow the line. How can a person compete with them?

When I first started following this board, I read some where: that no one respects the appraiser; s/he just fills out forms and signs them.

Is it not time for the appraisers to tell the lenders to get there act together and follow the guide lines. For every company I work for that wants to and tries to follow the rules, there are 10 that call me that don’t.

I would think that we as appraisers should be the ones to clean our own house up. If we don’t I would think that some day someone will just burry us as not useful.

Strictly a government employee cop-out. I think you can take this case further. Hope someone in your State will respond with some specific and workable suggestions.

By the way, did get the name of the jerk you talked with in the agency that regulates banking and mortgage brokers?

Your story is worth re-telling.

IF you have the time and can spend the dime, go NOW to your state legislators and throw the gaunlet down: Explain what is happening, how it hurts their constituents and what they can do to help:

You MAY consider filing a complaint to the Atty General, simply so the case has gotten some airtime and attention before lobbying and grousing your way through the system....

May I reccomend joining ACE as I think this is one of the efforts we may pursue: passing laws in all 50 states that require lenders to pay the appraiser?!?! See other posts which reference such laws in NC and other states.

I am going to be heavily involved in ACE simply because I want that law passed in my state and the ONLY way to get attention here is to have some intials on your card.

That said, do not feel like the lone ranger, AND was it Steve who posted the addresses of the Fed folks to whom one can send complaint like yours? I lost that data when my hard drive fried and died and cannot at this second find the hardcopy paperwork.

Grousing here may bring you sympathy, but DOING something about the problem is a better long term solution...

I am going to be presenting an educational seminar to the folks at the Fair Housing group and beleive me given the increases in bankruptcy this may become a real activist issue....

Ray, .....It sure does sound like you had a busy day of discussion with some folks you thought would actually "listen" to you and offer help ! As shared by Thomas...sounds like they did a good "government employee cop-out" on you. It might behoove you to let a day or two go by and then call back and specifically request talking to another person a level or two higher than the person with whom you spoke. As Lee Ann said, a call to the A.G.'s office would also be a good step to take. If this client has done this stuff to you, then they have likely done it to other appraisers, and the A.G. might begin to see the makings of a legitimate investigation ! --- Clearly, Ray, your interests are there in Wisconsin, but I had posted in the Clients - G, B, U category a little while ago a link to a very helpful data source for all 50 states. It might give some a bit of assistance when accepting some work from out-of-state clients. It's about 44 lines down in the thread history, still on that page 1, and titled as "FYI......". It is not a direct link from within, but one must transcribe and re-enter via independant web searching.

I also go to the referenced site and hit Control-C on the Address shwoing in my browser, then back to the forum and Control-V

to prevent those awkward typos from "precluding functionality" :roll:

I lost the two Fed report to addresses when my harddrive 86'd itself, anyone got those for Ray?

I "get" some of the bbc stuff but some of it is still a mystery!

The State Regulators are not here to help the appraiser they are here to protect the public against you. Watch your back with these guys. The most effective tool is the deadbeat area of this forum or push them off to you competition. Screw these pr***s use your time to find good clients.
