What about when there is no deck railing? Do we require that railing be installed for safety, or do we just recommend the installation?

In my area above 18 inches requires railing.

That does not mean you can not be sued!

I found my answer in an FHA FAQ list. I will note the issue and leave the decision-making to the lender & UW. If the deck were 8 feet off the ground with no railing, I suppose that would be an instance when I would make the report "subject to" a health/safety repair.
