I don't know how the banking regulators will respond to the issue - if it even gets that far. But have you given any consideration to what your fall-back rationale will be in the event - however unlikely - that these regulators end up disagreeing with you?
BESIDES that, I would hope that you would recognize that the banking regulator's policies only apply to the transactions they regulate. These regulators have no say over USPAP itself, nor over anything else that falls outside their jurisdiction. If this is a USPAP discussion then what any one regulator, company, lender or group does will only be a subset of a much larger whole.
