It is the lot that is non conforming. It is probably legal, NC because it was built before the zoning addressed lot size. This is called being "grandfather'd.
Typically, a legal NC lot with a house on it can be re-built in the same footprint as long as there are no health or safety issues. However, you must go directly to the source, the planning department, for an official answer.
