Virgina REAB and Portal Petition

And it's an important one.....the powers that be do not want us anywhere but under their thumb in order to maintain control of the appraisal. Success on this front would send a strong message that WE can come together to effect change that is in the best interest of the Public by fending off the self-interest groups. It only takes one state like Georgia or Virginia to get the ball rolling......

My highlights in blue.

As my instructor this weekend said "This is the time to come together".

It does only take one state that can start the process of change:clapping::clapping::clapping:
and thanks to all of you that are fighting for all of us!

Can't you just see the expression on an attorney's face when he files a lengthy brief with the court and finds out a new software program has been implemented that sucks his opinions out of that document, re-arranges it and populates a data base that's used to sell to others for profit?
I imagine it's the same expression they have (and for the same reason) when they read cert 21, cert 23, and find out the appraiser's fee is $200.

I thought that was resolved by 213.

Where did my post suggest it was a 1004 or a 2055?

That said, your mention of ANY certs should make all of us think twice as to why they're necessary or FNMA mandated.

My analogies are not limited by the contents of your posts.

I have no idea what that means. I can say that for many years, as a general appraiser, I saw residential practice as a safety net I could fall into if things weren't working out. Cert 21 and 23 are just two reasons that I no longer see being a residential appraiser as a viable line of work.

Cert 21 and 23 are just two reasons that

I recently was discussing with the lead attorney on an on-going assignment and these certs came up. It seemed to be his opinion that these statements have opened the barn door and in part are what he is using to pursue the appraiser.

Clearly, attorneys outside the lending community see these for what they are.
My personal believe is that this raises questions of the Intended User reporting requirements of USPAP in regards to Fannie Mae/Freddie Mac and otehr users of the form series ver 3/05.

One defense may just be giving borrowers an original to them prior to closing!
The waters muddy if they dont get an original. The issue that comes into play is what is the actual original? Is it the Native Software version or the modified FNC version?

Danny,

My question, back in post #206, is still begging an answer.

At this point, I can only conclude that any appraiser using the AIReady system is automatically in violation of USPAP (Record Keeping). That’s how I’m proceeding, unless I hear otherwise.

Oregon Doug

And why would you come to such a conclusion? USPAP mandates that appraisers have a true copy of the report (which is defined as the thing transmitted to the client). As I said in an earlier post, the AIReady version sits on my computer (just as the original forms software version sits on my computer), and I can retrieve either version that I want.

Can you share with us what Appraisal Software Company that you are using enabling the retrieval and printing of the FNC .env file?

We all might want to get that software so we can be compliant. If my board calls and wants a exact true version of the original report I need to mail them one or e-mail them a computer File so they can open it and view what I have.

Maybe you could help Doug out and send him examples of what your saying. This might ease his mind on the issue.

What is a true copy?

The information is the information, it is not a file type or the software program which displays the information contained in that file type. AIReady is not a report, it is a format. The native software program converts a report created using that software into the AI Ready format. The Appraisalport plug-in software, the OADI uploader software, is then used to transfer this information from the appraiser's computer to the Appraisalport computer. Does it transfer every dotted "i" and crossed "t" that may be depicted on a screen or printed on paper? No. Is that a violation of USPAP? No. Common data contained within a report type is the same on both ends. Why waste time, bandwidth, and storage capacity transfering common data? Does each proprietary software file contain every dotted "i" and crossed "t" depicted on a screen or printed on paper? No.

A true copy of the information delivered to the client or to any authorized party should be retained on the appraiser's computer and that information should be able to be recalled by the appraiser. If the information delivered to the client cannot be recalled by the appraiser on their computer, it would seem to me that the program which converted the information into the AIReady format is at fault. The converting program is the proprietary appraisal software program. I don't know enough about all the proprietary appraisal software program to comment if any or all of them retain the information converted to an AIReady format or not.

All this consternation about what file type represents a true copy is a dead end path. Does it really make any difference if the information is presented in a Word file, PDF file, ENV file, whatever file any of the numerous proprietary appraisal software programs create?

If I use DayOne for a year, decide I like alaMode software, convert all my DayOne files to alaMode files and erase the DayOne program from my computer, have I violated USPAP? Of course not. Why should it then be a violation to not retain the AIReady data if the information converted for that use is retained in the original software file type? If the converting program does not retain that information, it is the fault of the converting program. That program is the proprietary appraisal software.

Who here doesn't really think this is not about a conversion program, it's about data mining and power? One poster freely admits its about power. Numerous calls are mode t "take back our profession." Take it back from who and what? "Take it back" so we can give it to an Dodd/Crowley IVPI? I never did get an answer to my question to one party regarding the makeup of the leadership of the Dodd/Crowley proposed IVPI when that same party was adamantly stating that a single "Vault" should not be run by ANYONE associated with the real estate business. I don't know about anyone else, but I think appraisers are very much associated with the real estate business.

Others have already tried to fight FNC due to data mining. This isn't about a conversion program. If it was, it would not be just about AIReady.

I've spent enough time on this thread. I'm out.
