As others have said, the datamining/copyright issue is a separate issue and a battle to be fought separate from the concept of conversions/alterations and true copies

When the U.S Copyright office helped me with directions on how to get data from Mr. Vining's report that pretty much settled the copyright implications in my mind. If taking data from a report was a copyright violation, I sincerely doubt they would have helped me do it.

Mr. Vining said he would show me the error in my thinking when he returned from vacation. I am still waiting.

I keep going back to when Zaio had their "ASB Insider", and as Ken V. would say, "Key Figures", that would have an inherent impact on the Appraiser or the Appraisal Profession. And many asked, Why the "Secrecy"? Well it became very evident why. For Money and maybe future rewards.

It has been quoted, "I did not charge enough", this quotes speaks for it's self. And we still ponder on who are the "Key Figures" in the ASB per Ken Verrett.

So to try to tell one that they do not have the right to be on a Board, because of certain litigation circumstances, is shear hypocrisy. There is a Big difference between the two!

One was done out of Greed. The other, for the protection of the American Public/Economy and Duties that were applied to the Appraiser. I am sorry, but I rather go broke and be an Honorable Appraiser with Pride.

Yes, there are HUGE differences - the work I did for Zaio was done after I left the ASB, not while I was a sitting member - not while I was leading a committee investigating them, and not while I had filed a multi-million dollar lawsuit against them. I charged an hourly rate, and my compensation did not hinge on the outcome of my report - another big difference.

If you have taken the time to read the report I prepared you have seen that it was not a ringing endorsement; there was plenty of criticism. I should have charged more to compensate for the grief I have taken from those who choose to sling arrows without even reading the report :). If you choose to characterize that as greed, that is your right. I call it feeding my family.

If you see faults in my report, I would be glad to hear them. If there is such obvious bias, you should have no problem pointing it out.

I don't see how I could get any future rewards from Z - I don't own any zones nor any stock. Their system is innovative, but I can't make the numbers work for their business model.

An appraiser's highest duty is to independent, objective and impartial. An appraiser who cannot be independent, objective and impartial in an assignment is obligated to not participate in that assignment. I recall reading that in the document the VA board is supposed to be defending.

No DW, you are wrong, the first RULE per USPAP 2008 and past and the beginning of the Preamble and Ethics Rule: To promote and preserve the public trust inherent in professional appraisal practice, an appraiser must observe the highest standards of professional ethics............ RULE # ONE SIR!. Those are OUR FIRST DUTIES!

As for feeding the family, I thought you had 15 clients? while other are picking up cans and bending over for AMC chump fees........ As for your Report, you may want to talk to Z about that, they taught it as Golden in the Seminars.

I went to the seminar, You were the secret USPAP Hand...... Wiley, If I was getting crapped all over for someone else, I would be saying, "It's Not me, But them". Why take the abuse? why fall for someone else? Who are these, "Key Figures", why take their burden?

Sure USPAP adds Integrity to the list, but it's hardly separate from the others.

I find the venom in many of the posts in this thread hilarious, particularly when one post the proof someone was right in order to prove they were wrong. It's just too funny. :rof:
