Instead of moving forward, we should go BACK and put the AMC in the correct line. Then we can make progress in this profession.

And to those on the outside reading this forum. Hear this, the system is screwed up!!!
 
That's exactly what we have now, just didn't turn out the way some appraisers hoped for. And I'll repeat what I told you and the C&R crowd when this started: the regulations mean what the regulators and their attorneys says they mean-not what appraisers think they mean. So here we are again, at the end of another push for enforcement. Just like the HVCC ended in disaster so to has C&R.
C&R is a misnomer. A misunderstanding and mislabeling. The Holy Roman Empire was neither holy, Roman nor an empire. The battle of Bunker Hill was not fought on Bunker Hill. The Pennsylvania Dutch were actually of German ancestry.

The LA boards finances, or lack thereof, as related to their ability to defend their actions are not and never were the issue.

So how is this different?

General Schedule Pay Rates

  • The General Schedule (GS) is a worldwide pay system that covers more than 1.5 million employees.

  • The GS pay schedule has 15 grades and 10 steps in each grade covering more than 400 occupations. Pay varies by geographic location.

  • The law requires a two-part GS pay adjustment in January each year with pay adjustments based on surveys conducted by the U.S. Bureau of Labor Statistics (BLS).

  • Based on legal requirements, BLS conducts locality pay surveys in 47 separate geographic areas, with survey data representing non-Federal salaries (including State and local) at distinct levels of work.

  • Since a distinct work-level to work-level pay comparison is required, beginning pay rates for GS jobs must be compared to beginning pay rates for non-Federal jobs at the same level of work, etc.

  • In the locality pay program, Federal pay is compared to non-Federal pay for the same levels of work. The results of such pay comparisons can be found in annual recommendations of the Federal Salary Council and in annual reports of the President’s Pay Agent.

no one, other than you, has specifically talked about the funds of the LA real estate board. if you think that they have enough funds to fight a case against the FTC on their own, or any real estate board in any of the 55 territories/states, then i have a bridge in NY and some waterfront property in FL to sell you - cheap!

the board is part of the state, who would have to pay the legal bills for fighting the case. it's painfully obvious they either

A - don't have the funds to fight the case to the governor stepped in and squashed it

or

B - won't be able to win the case so the governor stepped in and squashed it

take your pick.

And if you recall,
I've always said C&R is what appraisers accept so stop taking low fee work.


But I find it interesting that the focus is on setting a price, instead of focusing on the price fixing that has occured and is on-going.

Because this becomes more of an issue with the Trid update, as the borrower can only be charged the "average" of appraisal fees. Not the "cost" of appraisal fees,

so going forward, somebody is going to have to show the "average" appraisal fee was charged to the borrower, without price fixing the appraiser's fees.

And ghee, that means that some appraisal fees will be more than average, yet can't be charged to the borrower.


Oh this is so much fun.

I beleive you are correct.

I have not seen any state budget that includes money for defense from Federal Regulators.
