Look at this inside photo. That's the front door - and that's the area in dispute to the left. Compare with the outside shot. Sure looks like that is ALL 1st floor - level with the ground, doesn't it? The height of those windows is deceptive from the ouotside.
Ok, if the basement floor is level with the bottom of those windows, then it is not below grade. But, then you prolly have a 5' basement ceiling height. Is that visualization helpful.

CLEARLY? You would need to have been inside the home to be that certain from a couple of photos (which can distort in either direction).
I agree with the original poster that a few INCHES of that stuff on the ground in front of the windows may be very loose, "fluffy" garden stuff they put on top of the ground to make it look pretty for buyers. Am I sure? Nope. Would have to put my eyeballs on it - or at least see some high-res multiple-angle photos.
