Drainage Hose From Leaking Water Heater

I went out on a conventional refi and noticed a small drainage hose running from water heater to the backyard. Owner said water heater is leaking and he rigged up the drainage hose. Should I consider this a health and safety issue?
I appreciate your input.
 
I'd consider it a leaking water heater, mention it, perhaps estimate the cost to replace it, type the bill and go on to the next assignment. It isn't a health and or safety issue.
