You really think that’s how the legal system works? Do you think one attorney on appraisal board that isn’t even devoted to the board full-time has any interest in fighting a team of lawyers being funded by hedge funds? Threats and money win in court, not much else matters.

Also, let’s not kid ourselves, these are state government attorneys. A well funded private law firm will eat them alive. It doesn’t matter what position they take.

It wasn’t a difficult decision, they rolled the dice That appraisers are too disorganized to ever sue, but when a suit gets flown in from across the country and basically threatens a lawsuit should they attempt to enforce state appraisal laws, they take that more seriously. It’s an easy choice for them. I get it.
All you're doing here is confirming the point that the state govt came to the conclusion that their argument wouldn't withstand judicial review WRT how the verbiage in the laws and regs are actually worded. I'm guessing it was their own attys who explained the facts of life to them. If you want to credit the "threat" of a lawsuit along with the explanations being provided, that further illustrates the possibility that maybe those govt lawyers came to a more-informed decision. Of knowing more about what they were entering into after those hearings than before.

Even if you want to attribute that decision as being the result of the govt attys being uncertain about the outcome, that still functions as an acknowledgement of the point that in our legal system the burden of proof in a civil case consists of the lower "preponderance of truth", not "beyond a reasonable doubt"; that burden resting with the accuser, not the accused.

So under your best case scenario if the state govt is uncertain about their chances WRT the lower "preponderance of truth" that shows how the merits of the case are NOT as obvious and clear cut as you seem to believe. In our legal system the tie goes to the runner, not the plate.

I actually can't remember what the NC Board issue was . I really don't care at this point... but someone tell me anyway
 
The AMCs must be exposed. Then, these AMC should be reported to the state, where they will lose their license for hiring incompetent appraisers. problem solved. You guys are talking nonstop, while the solution is under your nose. One of you, create a website that exposes these AMCs. i don't have the time to do it, and i'm not that computer savvy. You can even charge people and make money on the side, I will pay to a small fee to share my experience on this website. On the first page of the website, about page, state the mission statement along with how AMCs are harming the public trust, stealing 85% of the fee, legally stealing, and harming everyone involved, etc.

Knock yourself out. Sue the AMCs for hiring "incompetent appraisers" and see how that goes.
You mean how it goes for the AMCs, or how it goes for the "incompetent appraisers"?
