FHA Crawl Space Requirements

Don't you understand how the guides and handbooks work? The 4000.1 (formerly 4150.2) is intended for the mortgagee (that's the lender in case you didn't know) as well as the appraiser. Some requirements apply to the mortgagee while others pertain to the appraiser.


Mortgagees must secure all in-ground swimming pools, hot tubs, and spas as required by local laws, codes and ordinances. The Mortgagee must:

That's what the mortgagee must do. I looks like it is in the section for HUD owned properties (foreclosed.)

I don't recall the OP mentioning the property being appraised is on tribal lands.



Embarrassed for you. You need to take some classes on FHA requirements. I would love to review an FHA appraisal of yours. with a pool, no CO sector, water heater straps. Does it have 1 of the 7 safety features allowed in CA for a pool? Is that crawl space access door locked? Is there a doggy door on the firewall door? Ohh, you didn't subject to those things that aren't up to state, local law?

Same goes for FNMA selling guide. I can call you out from the selling guide on those too if you would like.

Out of the handbook you forgot to read;

"(c) Pools, Hot Tubs and Spas
(i) In-GroundPools,HotTubsandSpas
Mortgagees must secure all in-ground swimming pools, hot tubs, and spas as required by local laws, codes and ordinances. The Mortgagee must:
  • secure the pool, hot tub, and/or spa with a removable safety cover anchored to the pool deck or, if a cover cannot be anchored to the pool deck, board or otherwise secure the pool, hot tub, and/or spa; and
  • secure and repair any fences around the pool, hot tub, and/or spa to restrict access."
The rest is from the default section of the handbook. These are the mortgagees responsibilities.

It's up to the client on how they want the appraisal made. Sometimes I get requests regarding HUD owned properties that must be made "as is" no matter what is wrong with the property.

f. Swimming Pools

The Appraiser must report readily observable defects in a non-covered pool that would render the pool inoperable or unusable. If the pool water contains algae and is aesthetically unappealing, but the Appraiser has no evidence that the pool is otherwise contaminated, no cleaning is required. Swimming pools must be operational to provide full Contributory Value.
The Appraiser must condition the appraisal report for pools with unstable sides or structural issues to be repaired or permanently filled in accordance with local guidelines, and the surrounding land re-graded if necessary.

If the swimming pool has been winterized, or the Appraiser cannot determine if the pool is in working order, the Appraiser must complete the appraisal with the extraordinary assumption that the pool and its equipment can be restored to full operating condition at normal costs.

Again, if the property is proposed, new (less than 12 months) or the assignment is for the 203(k) program, the Minimum Property STANDARDS apply and that includes applicable laws and codes. MPS is different from MPR (Minimum Property REQUIREMENTS) where applicable laws and ordinances do not apply. The appraiser must report and the client then has the information needed in order to proceed, not proceed or require the borrower to make changes.
 
I see no systems, insulation is in pretty good shape (tho not required), no dead bodies. Its good to go.

The mortgage god's have set FHA rates at 1/2% less than conventional, so its the product de jure.
 
I'm pretty sure CAN has forgotten more about FHA requirements than most of us even presume to know.
He's been one of the leading FHA "go to guys" on here for years (y)

I would complete AS IS, add pic(s) and leave it up to the UW

I am a little confused by your super-snarky and combative response. Especially since there was no mention of a pool in any of the conversations pertaining to my issue with the crawl space. Thanks for the random rule dump though.
