Following the advice of a respected forum member I am making this post. In a short period of time, I will be filing a complaint against a so called member of my profession. The purpose of this post is to gain any insight into filing the complaint. I have never filed a complaint. I have had a complaint filed against me by our dear friend the chief appraiser of chase and flagstar back in 2008. So I am familiar with part of the process. For the record I was accused of fraud and quite a number of other things. I represented myself and endured 45 minutes of grilling by the board. The end result was a fine of $1,000 for not using the correct designation and court costs of $500. I believe that I will have to quote USPAP and reference the failings of the appraiser, correct? If anyone has experience with filing a complaint or the process, I would appreciate your input. Just to let everyone know how bad this appraisal is, the so-called appraiser delineated the neighborhood boundaries as being the second largest city in Florida.

And some say the boards look at the big picture, eh?

Well, check with your state regulations. Can you file it anonymously? Then do so with minimal commentary. My board can initiate an investigation upon their own.

If you have to file a formal complaint...be vague. "I don't think it is credible. etc. IF you did a review of it as part of an assignment, then your report will be a matter of consideration. A lot of reviewers in my state were turning people in and ending up on the receiving end of the sanction themselves. I'd let that sleeping dog lie.

Otherwise, if I wasn't going to turn it in and they didn't deal with anonymous complaints, I would send it in anyway....at least it would alert them to the issue with that party.

As for USPAP, I don't think you need to do anything but point out an error or two and why you felt is was wrong....do not quote USPAP...

As an appraiser Id be very "leary" of pointing out USPAP Violations ... only a state board has the authority to make that determination .. I may point out Potential Violations but Id make the wording very cautious given the board authority to do so.

Well, check with your state regulations.

Unless Frank G. answers your post, you should check the state regulations and procedures. I wouldn't rely on someone walking you through the process on this forum.

Good advice. In California, the complaint form doesn't ask for "USPAP" violations. It just asks what are the concerns the complainant has about the report (and, who is the complainant and how did he/she come into possession of the appraisal).

The times when I've filed a complainant, I don't cite USPAP.
I just outline my concerns and let the state do their thing.

Thank you Denis

Thank you Denis, I had forgotten Frank G used to be a member of the Appraisal Board in the State of Florida. I will contact him.

They just don't let you out the door without leaving something behind huh?
