Florida State Test Question

That question is so bad. Makes you wonder if an unlicensed appraiser wrote it.

Or somebody who hates licensing?

Probably some alternative appraisal lobbyist.

So the Judge picks an unlicensed appraiser. The plaintiff or defendant could just hire a licensed appraiser. Who has better standing. Not even close.

It may be the worst test question i have ever seen.

Idk, It could just be somebody who don’t understand innocent people go to jail and guilty people go free.

Hit the Income tax situation and employee/independent contractor law is the way to hit it in FL and other states. States know tax law. Lol

They know antitrust law too.

Just have to follow the money. Lol

The FTC is not stupid.

I wouldn’t doubt they have hired some experts in real estate appraisal. La already has some experts. Antitrust issues like unfair trade practices are different. The FTC is an expert in unfair trade practices.

Note how graciously they are accomdating La.

It is a bad question for somebody to fail an exam on.

USPAP applies to appraisers. The way I see the TN state law (not USPAP), is you better be licensed as an appraiser to call it an appraisal.
Well.......As I said early on in this thread, the answer in any jurisdiction would depend on the laws in that jurisdiction. But the question is on a Florida test, and Denis provided citations from the Florida law. So, it seems to me that the state law angle is handled. The correct answer in any other state might be different, depending on that state's laws.

Taken at face value, the question seems to be an intentional attempt to see if the Florida applicant is aware of the citation from Florida law that Denis provided. Given what Denis provided, there really isn't much to discuss or debate with regard to that test question (which I realize will not stop appraisers on FB of AF from going on for hundreds of posts).

Well, if that is a state test in Florida, the source would be the Florida state law. Woudl it not?

Testing knowledge of state law is common. In Wisconsin one not only has to pass a general test, an applicant also has to take a separate test specifically on the Wisconsin law.
 
Common Core test writers must of have taken on second jobs.
