A JE requires a conflict between law and USPAP. USPAP says that who must comply with USPAP is a matter of law, regulation, agreement and choice. So, matters involving who must comply with USPAP can never be based on a JE, because there could never be a conflcit.

It is important to be able to figure out the context of the questions on exams. "D" would be the correct answer in the context of a general question pertaining to USPAP. In my experience, based on the CG exam I took at the end of 2013, most questions are of that nature.

The answer would be different in the context of FL law/regulations. Since FL is a mandatory license state, one couldn't legally collect a fee for a service that one isn't licensed for, barring some specific law/regulation pertaining to the specific instance of court-ordered appraisals and compensation for unlicensed individuals.
 
Bottom line. You can’t buck a local court of law. You can appeal it, but you can’t buck it.

The judge will put you in handcuffs if you try to buck them like riding a bronco.
