Well, maybe that is how you think it should have worked, but sorry that is not how it actually did work. Besides, Scalia is dead so now how should the Supreme Court function? Should the Supreme Court perform a seance before deciding every case to see if they can channel Scalia's spirit in the netherworld and follow whatever it is that Scalia's spirit tells them to do?

She is obviously a legal genius and I am sure that the FTC attorneys who apparently are completely ignorant of federal law undoubtedly cannot wait to be educated by her...they will be especially interested to hear how pitiful it was for the FTC to cite the NC Dental Board case in the complaint against the LREAB

You don't have to be a legal genius to read the CFPB's RESPA ruling concerning 8b.

If borrowers can be over charged, and charged for services that are not performed, and not be financially harmed by that....

What was the point of anti-competitive laws? To negotiate day employment contracts, or protect consumers?

The difference between you and I is that I have actually read the FTC's complaint, the LA Board's response and the case law cited by the FTC in support of their complaint (i.e. the NC Dental Board Case). Considering that the NC Dental Board case is a FTC case that made was ruled on by the US Supreme Court and is established precedent, I am quite sure that the FTC's Administrative Law Judge that will hear this case and any federal court judge that hears any possible appeal (if this case gets that far) is going to follow Supreme Court precedent (or they will get reversed on appeal). No offense, but your comments regarding the NC Dental Board case shows an utter and complete ignorance of the facts and issues involved in that case and the precedent set by that case.

AMCs are not Fee Appraisers.

We can't compete with them. They provide a service to lenders, managing the valuation process, that we don't provide. We provide the liability for the value by signing the reports, which AMCs do not do.

That's all very different than Dentists all competing for the same rotten yellow teeth and insurance checks.

After all it was the Dentist board that banned non-dentists from whitening yellow teeth, which, comes under Dental Practice.

Managing a service contract, does not come under Appraisal Practice.

You gotta love USPAP - It has definitions.

It might even be an idea, to re-read the FTC suit against Corelogic,

and then realize the 5 year time frame for having make believe competition has ended.

Oh, ghee, back to being a monopoly, but they paid their dues, so it's okay now.

I learned States are normally immune to anti-trust laws. The big Red machine would be proud.
 
Some appraisers I know live in states where they have former housewives and totally disinterested 3rd parties that are friends of the governor that sit on boards. They said the appraiser members are engaged and participate in the conversation, while the board members that are there to give them something to do every few weeks just sit there and read the paper during hearings. They never say a word, never pay attention, then cast a vote to destroy a persons career.

State regulated professions are in a lot of trouble if you don't have people in the profession on the boards. I have no idea the makeup of the LA board, but you should have a mix.

People make a big deal about SC cases, but great minds can disagree. Not every case is 9-0. And as cases get argued from a different viewpoint, opinions change. The NC dental case applies to state boards, but the arguments regarding AMC's and unlicensed people practicing teeth whitening isn't really the same as appraisers and AMCs.

I get it...anyone who disagrees with you is probably a commie and anyone who believes that the federal government should even exist is definitely a commie and the other 8 Supreme Court justices who sat on the court with the apparently infallible Scalia are complete ignoramuses who know nothing about the constitution otherwise they would have always agreed with Scalia. In fact, they are probably all commies too. Other commies undoubtedly include anyone who has ever worked for the the FHA or either of the GSE's
