HUD Had No Legal Authority to Investigate Most Appraisers - and They Knew It!

I remember the PAVE website had in their mission statement that appraisers using comps in the same neighborhood was racist. They were literally attacking appraisers for not cherry picking.
 
Their understanding of appraising is so superficial that they think they can get around "location, location, location" via use of the Cost Approach and Income Approach. Apparently without realizing locational similarity applies equally in those other modes of analysis.

What does it mean to the values when the market rents for 2bd units are different in different locations?

appraisers give 'opinions' of value...per the united states constitution 'congress shall pass no law prohibiting or abridging the free exercise of'.... :rof:
 
An individual's 1A liberties are extremely broad.

By contrast, the conduct of an appraiser who is licensed by the State is subject to certain terms and conditions.

Appraising for FRTs and other regulated activity is not a right, it's a privilege. Terms and conditions apply; one limitation being the prohibition upon the "liberty" of infringing upon the legitimate rights of a buyer or seller or mortgagee in a lending transaction.

That's an annoying non-sequitur

As a licensee you are prohibited from lying in an appraisal report. You're also prohibited from infringing upon the legitimate rights of another in an appraisal report. These are among the terms and conditions you agreed to in exchange for earning and maintaining your appraisal license. Nobody forced you to get an appraisal license or to accept the assignments which require compliance with those laws and regs.

Bust a deal, face the wheel.

Appraising for FRTs and other transactions is a privilege, not a right. MOST people are not authorized to perform those assignments.
 
Nobody disagrees that Pave and HUD actions were Gestapo like operations and if they were ever tried and if the case got accepted into the Federal Court's it may prove to have violated Federal or have been Unconstitutional.

But until some wealthy person, or Lawfirm files the lawsuit and it's accepted by the Federal court it's just a pipe dream.

The constitution is violated every minute and unless someone is wealthy enough to fight-- it's a mute point. Your just talking to yourself because your audience doesn't have the money. Maybe you should fight these cases.
 
HUD’s ability to initiate an investigation on their own is likely within their legal authority for laws under their jurisdiction.

I can tell you that CA’s licensing agency has such ability. It wasn’t used often when I was there but I can think of several times it was.
