Judge Rules Appraiser/Lender Owe no duty of care

The more you say it, the less I believe you. You are the one who is "intentionally concealing photographs" which might confirm this by now, "baseless accusation". You have given no reason why you won't post one either. You better not try these antics in front of a jury. Again, not "legal advice", just "common sense".
What's common sense is concealing numerous items and cropping them out of pictures from numerous angles is intentional.
 
I never went through FHA loan process.
What more can FHA loans be to let buyer/borrower that the lender's appraisal can not be used as an inspection report or not for their personal uses.
Do buyers/borrowers get a disclosure letting them know FHA appraisals are only for loan purposes?
 
Stop asking her for pics. She obviously wants to withhold them and certain other information from the discussion. Besides, whatever errors the appraiser made exist independent of the OPs veracity.

Just because buyers are outnumbered here on your appraisers forum does not mean they will cave to your "due diligence" speeches to try to absolve appraisers of their duties.
Many non-appraisers come here seeking advice from The Forum. With the many laws, rules, regulations, we have to follow including; USPAP, Fannie Mae guidelines, FHA MPR's, lender guidelines, lender assignment conditions, etc. We've helped numerous people navigate through the above aforementioned items and they've been very thankful and appreciative.

I suppose with appraisals, we can't boast a 100% helpful record. Especially with those seeking advice in opinions of a value they feel is too low..... or in your case, those seeking vengeance.
 
Be serious - she's not seeking vengeance. She's seeking coverage of her losses. And we have had a certain percentage of laypersons coming in for an explanation only to leave without satisfaction. Often with claims they'll be back when their situation settles with proof that they were right and we were wrong. I don't recall ever seeing one of them return with such proof but there's always a first time.

I wish Privateer were here to set us all straight on the legal angle. He would definitely know where lie the boundaries in various states WRT liability to 3rd parties for grievous errors.
 
I'm curious. Was the buyer's real estate agent sued to help cover the losses?

We have other attorneys on this board. The one I had in mind, however, he has placed me on "ignore" though, so no help there..

lol what more can be done to inform borrowers of FHA MPR so they can ensure it's been completed since FHA can't?
