Modular Housing Labels

This new information posted on the HUD.gov website would only apply to manufactured homes constructed to the HUD building code, not modular housing which is constructed to the applicable local/state building code. The HUD label is red when it originally leaves the factory then fades out to orange or pink or gray or silver. But the words Housing and Urban Development are etched into the metal. A modulular housing label varies in color and shape from state to state and does not refer to Housing and Urban Development.
 
Speaking of HUD Labels in AZ

We have been asked to do an engineer's certification of a manufactured home foundation in AZ. Prior to going out for the inspection, we like to do advance research so the borrower doesn't incur extra costs. In evaluating the appraisal report and the pictures and matching them up with the HUD labels, the home appears to be older than the labels look. In California we can run a quick title search to see if the numbers match up. Does AZ have such a thing or does it have to go through IBTS? My instincts tell me this is a pre-HUD home but the HUD labels tells otherwise. The appraiser could not find the compliance certificate on the inside.
 
If the mobile/manufactured home is taxed as real property there would need to be an Affidavit of Affixture recorded in Arizona. Although there is a possibility it has been taxed as personal property and the Affidavit of Affixture will need to be recorded prior to recording of the Deed of Trust. Call the client, ask which title company is handing the escrow and the name of the escrow agent. Call that escrow agent and ask them if they have located any recorded Affidavits of Affixtures or do they have access to the Motor Vehicle title for the home. If the model year on that Affidavit or title is 1977 or later than it is a manufactured home. 1975 and prior would be a mobile home. If the model year is 1976--then research would have to be done with IBST by the lender. If you are in one of the small counties, talk to the personal property/mobile home section of the county assessor's office and see what information they have. Big counties are not so helpfull. They don't care about whether the home was constructed to the HUD building code or not but they do have to have access to the original title or Manufacturer's Statement of Origin prior to placing the home on the tax rolls. That is their source for the year of construction (they use the model year) and the original factory list price on those documents is the basis of the valuation for tax purposes. Only a recorded Affidavit of Affixture is in public records. The Affidavit of Affixture is strictly paper work to enable the unit to be taxed as real property. No inspections or any requirements for installation are needed prior to that recording. The original title or MSO is surrendered to the Motor Vehicle Department, the Affidavit if Affixture is filled out and recorded--viola---real property without any other activity.
 
What are the HUD numbers? They are sequential (mostly). I did one (FHA)
HUD numbers were CAL010*** and the 433 (foundation certificate from the
county said it was 1986. CAL010 is a 1976 or 1977, not 1986, I required title documents from the MB and they canceled the request (this was before they
could reassign the case number) and someone else did it as a 1986.
 
We do engineer's certifications on manufactured homes and have found more and more often that incorrect information has been transferred on both the 433A, insurance documents etc. We always do a title search with HCD prior to an inspection because we don't always trust the documents that are provided----some lenders just want to get the loan closed even if some elements don't match up. And who do you think would pay the price later on---either the appraiser or the engineer, don't you think?
 
I've seen white labels but no blue labels. Red is the worst color to use for things outdoors because red is very sensitive to UV.
I prefer Black Label.
