North Carolina Appraiser Background Check Law Passes

When it comes to BC checks on an appraiser for the benefit of a lender, I would rather the authority issuing the appraiser license be in control of the background check and confidential information, just like authorities over the license of lenders are in control of confidential information with regards to regulating lenders and the license (charter) lenders have to operate their business. Why should appraisers be treated different from other business's? This is not the total answer yet, but it is a step in the right direction and leveling things out, imho.

Lenders are not even required to have background checks, are they? I guess the state may find out how much demand they have for them. Maybe it will generate some money for state govt one day for things like roads and schools and police protection. Maybe, turnabout will be fair play one day and appraisers can get some info similar to bc checks and other info on lenders and AMC's.

Obviously, on a world wide scale, confidential information is becoming a hot topic.

Yeah. I totally agree with you. I don't know if my local sheriff or police department would do that. I'd certainly pay for that service and I'd prefer to be the one in control of my information.
That's what most have been preaching since the beginning of this mess. We aren't against reasonable background check rules and regulations performed by state boards. We just don't want Joan and her AMC friends controlling, selling, manipulating background check information.

Joan collecting then selling information on every appraiser in the nation is no different than the person flying a drone over his neighbor's yard while teenaged girls are out by the pool. It may be technically legal but reasonable people know it's an invasion of privacy, and some are finally fighting back.

That guy in Kentucky had his right to "quiet enjoyment" of his real estate infringed, and.............

If his daughters are under age................

With a good lawyer................

we might get a different headline. We'll have to see how that one plays out.

Commercial airplane or not, does not give them a pass on kiddie ****, and a father has a right to protect his children.

You do realize that a State agency actually hires a third party background check company, right?

Eli, I realize that in a perfect world that would be a great solution. But the fact of the matter is many lenders choose an AMC for vendor management as much as the "chase and place" aspects of the order. Their regulators are all over them for the appraiser selection process and that is why you are seeing all sorts of demands for due diligence.
 
I am very close to the business of vendor management and compliance. I see SLAs and engagements every day. The State appraisal agency has no authority over the lender. This was an AMC law, not a bank regulation.

Some do, some don't unless you want to push your typical Joan spin and imply their state police agency is a third party.
 
In this case, North Carolina does.
