Peeling paint on outbuilding

I recently completed an inspection for an FHA refi. The subject dwelling met all the MPRs. The subject site had 1.8 acres. There was an older outbuilding located on the back end of the site which had peeling paint. I always understood the MPRs to apply to the dwelling and attached improvements. Is my recollection correct?
 
Your recollection is NOT correct.

Lead Based Paint Hazards
For any home built prior to 1978, check for evidence of defective paint surfaces, including: peeling, scaling or chipping paint. For all FHA insured properties, correction is required to all defective paint surfaces in or on structures and/or property improvements built before January 1, 1978 in accordance with 24 CFR Part 35. Provide a detailed description and identify the exact location of any deficiency under “physical deficiencies” affecting livability.

The problem is that the section quoted clearly states "any HOME". A detached outbuilding is NOT a HOME.

I just inspected a 30+ acre property with a 1984 manufactured home and 9 out buildings. Every single outbuilding had defective paint surfaces and a large loft barn was partially collapsing. I called for repair of all safety and structural soundness issues in all 9 outbuildings including correcting all defective paint surfaces and repair of all dryrot issues...needless to say the parties to this sale transaction were not happy...

I think the actual issue is whether the the home was built "before January 1, 1978." The point of the requirement is the concern about lead based paint, not whether or not "any" paint is peeling, scaling or chipping. If the paint was applied after January 1, 1978 then the above requirement would not apply.

Appraisers MUST follow the protocols prescribed in the HUD Handbooks. Defective paint surface on improvements built prior to 1978 fail MPR and the appraisal MUST be conditioned on repair.

It's as simple as that.

Ummm ... Isn't that what I said? Not trying to be argumentative here, but I think I said essentially the same thing you said, re built prior to 1978. Also, the rule is under the heading of Lead Based Paint Hazards, so my reading took it to mean that this lead based paint is the fundamental concern that led to the requirement.
