I think the actual issue is whether the the home was built "before January 1, 1978." The point of the requirement is the concern about lead based paint, not whether or not "any" paint is peeling, scaling or chipping. If the paint was applied after January 1, 1978 then the above requirement would not apply.

CAN is correct. The requirement is not for when the paint was applied, it's for when the structure was built. Subsequent "newer" paint layers serve to encapsulate the older possible lead paint. It last year's paint is peeling, it still fails MPR because that paint is no longer encapsulating the alleged "bad" paint beneath it.
