Quick question regarding FREAB

I just looked at the "meet the board" section of the FREAB section of the FBPR website and I am a tad confused.

I know that there is now a requirement for representation from the AMC's, but I didn't know that there was supposed to be 2 AMC representatives. And my main question is, how is one of the AMC representatives THE CHAIRPERSON of the board?
Is this just a title that means nothing? Or were the AMC's just given an upper hand in appraiser regulation in the state of Florida? Something just doesn't look right there.

I'll be on the road this week, so I may not be able to respond much, but I'll try to when I have a chance.
 
Why did you not know it was two AMC representatives? :shrug:

It's nine members: 4 Appraisers, 2 Consumers, 2 AMC workers, and 1 Banking/Mortgage worker as members. The chairman runs the meetings. This is not the first time the chairman was not an appraiser member, get over it.
 
I did not know that there was to be two AMC representatives. It's fairly recent that there was a requirement for any AMC representatives from what I recall. And some states have no requirement for any representative from an AMC yet. Your's is one of the states that requires one AMC rep, OR a banking industry rep. So why is it so shocking that I wasn't aware?

There's really no need for a "get over it", there's nothing to get over. I am concerned that the chairperson of the Florida appraisal board is a representative of appraisal management companies. Who, last time I checked, have had a rather negative effect on lending appraisal in just about all states. I honestly didn't know if it was a big deal, or not. That's why I asked. But thanks anyway.

If memory serves correctly one of the AMC members is also an appraiser. The board actually found a loophole in the new rules and got one of the existing board members appointed as one of the AMC members and then added another appraiser to the board.
 
I have not been following the Board members closely, but I do recall during CE back in April/May that the Board had a number of vacancies and the CE instructor said the existing members were working huge overtime on the all the various agenda items. I suspect that if they were able to find one or more additional members they jumped at it.

It is not so much a loophole as it is that only the general public members are prohibited from being part of one of the other groups that have representation.

For those not familiar with the law, here it is:
475.613 Florida Real Estate Appraisal Board.—
(1) There is created the Florida Real Estate Appraisal Board, which shall consist of nine members appointed by the Governor, subject to confirmation by the Senate. Four members of the board must be real estate appraisers who have been engaged in the general practice of appraising real property in this state for at least 5 years immediately preceding appointment. In appointing real estate appraisers to the board, while not excluding other appraisers, the Governor shall give preference to real estate appraisers who are not primarily engaged in real estate brokerage or mortgage lending activities. Two members of the board must represent the appraisal management industry. One member of the board must represent organizations that use appraisals for the purpose of eminent domain proceedings, financial transactions, or mortgage insurance. Two members of the board shall be representatives of the general public and shall not be connected in any way with the practice of real estate appraisal. The appraiser members shall be as representative of the entire industry as possible, and membership in a nationally recognized or state-recognized appraisal organization shall not be a prerequisite to membership on the board. To the extent possible, no more than two members of the board shall be primarily affiliated with any one particular national or state appraisal association. Two of the members must be licensed or certified residential real estate appraisers and two of the members must be certified general real estate appraisers at the time of their appointment.
If my memory serves me right, the changes were made in 2010 with an effective date mid-2011. It was all part of the implementation of regulation of AMCs.

Yes, the chairwoman/AMC representative is also an appraiser. Her name shows up on the national registry.

Fran Oreto was originally appointed to the FREAB as a Certified Residential member. She was elected Chair in 2011 and elected again as Chair at the first meeting of 2012. When her term was up Governor Scott appointed a Certified Residential Appraiser from Naples to fill the slot. Shortly afterwards, Scott appointed Fran to the remaining vacant AMC slot, and the FREAB opted to keep her as Chair.

Fran has long been affiliated with Landsafe.

That makes sense. But who is Fran "employed" by? I should know this, but I can't remember.
