Real Estate Lien

I was told by another appraiser, that if payments have not been made within the 30 days, they attach a lien on to the real property (includung late fees). They said most times it's caught in the closing and a check is cut as a result of the HUD 1. Other times, when the loan doesn't close, the homeowner has complained to the mortgage company to pay the fee to remove the lien. Sounded a little fishy to me. Anybody ever tried or heard of it?
 
Depends on where you live and the laws of your state. Some allow for mechanics liens ..... mine does not ... Of course it would help if you had your location on your profile so that maybe someone in your area could respond....
 
I have heard that it is not allowed in Indiana. If anyone knows something to the contrary, please post. If anyone knows, is such a lien allowed in Kentucky?
 
It's not allowed here in NY either.
 
Mechanics liens in NC can be filed up to 120 days after the work is completed.
 
Can't do in in AL. Going to ask my lawyer if a Home Inspector can though.

No, but you can take the borrower's sister, cousin, or daughter in trade. :rainfro:
 
We tried it here in California, but you have to "improve" the property in order to file a mechanics lien.

Since the appraiser does to add anything to the house, it was a no go.
