Retrospective Values And Prospective Values

WRT the retrospective value, I agree - you have to use an EA about the subject attributes, which I do every single time I perform one of those assignments.

As I see it, the difference between the use of an EA with a retrospective or a prospective on an existing structure is that with the retrospective you have proof that it existed in the past, and with the prospective you have proof it exists now. So that default exists as the basis for the EA. This is not the case for a "subject to" that by definition will require an HC just to come into existence as such.

You sidetracked and hijacked you're own thread, as future construction was not part of your original post.

May I now then ask, what was it from the original post you wanted to discuss, but was missing (proposed construction), or was the original post intended to discuss what does exist, has existed, and is expected to continue to exist in the future?

I'm confused as to the point of it all.

If you read post 7 in the thread you'll see where the "subject to" element of the discussion came into play. It's not a hijack because it's a variation of prospective value, and as i understand it, for some lenders it's becoming a common one.
