Heyden was disciplined in NB first??
http://pr.mo.gov/boards/appraisers/discipline/William Heyden.pdf

This might be an interesting read
http://pr.mo.gov/boards/appraisers/discipline/Richard Cunningham.pdf

I also noticed an inordinate number of folks who get sanctioned for not having their CE and USPAP completed by the date that they certify. They often have the hours but took them weeks or months after they paid their dues and claimed to have completed CE. Duh...just too busy to screw with it? Com'on how hard is that? At least in my state they do require we show the proof of the class BEFORE we can renew, not merely state we have done it.

Heyden was disciplined in NB first??

I read that. I was kind of interested in Heyden because I had had a past contact with him. His sub called me asking for land sales. I gave her some on the condition that they share anything else they find with me. They never called back. Didn't find anything?

Anyway, looks like he frequently went far afield.

So, interesting thing. I went and looked on the NE site and couldn't find anything there about him. Maybe they just haven't gotten around to posting it yet.

I was reading this newspaper about real estate appraisal and I must say this is the best thing I ever read in a long time. I can't believe I left that magazine "Working RE" (Spring 2011) sitting on my desk for such a long time. Anyhow here is a snip...

"(p30) Since violation of a state's appraiser certification law is not a crime, the protection of our Federal Constitution - "innocent until proven guilty", does not apply. When the state sends a letter it informs you that you are guilty of a violation of USPAP and/or state law. There is no hearings, no trial, no judge, no jury. You are guilty. You can defend yourself and the state may even drop some of the charges. However you are guilty of something for no other reason than the state says you are.
(skip)
The state, as you might guess, is under no legal obligation to charge and judge equitably.
(skip)
Also, it states do not uniformly apply the "failure to exercise reasonable diligence" charge, it leaves the appraisers wondering under what circumstances failure to maintain a workfile properly is "failure to exercise reasonable diligence".
(skip)
Failure to understand the law will not protect appraisers from it.
(skip)
A common complaint is that USPAP is not enforced uniformly by the states.
(skip)
The problem, however, is that each state is sovereign in the creation and enforcement of its laws, so the complaint of unequal enforcement is both true and irrelevant."

And a few lines later on, there is an example where one appraiser is charged for violations in state X. When he moved to state Y, he had to disclosed his previous violations. However the state Y told him he would not be charged with these violations, and the state Y would not even have opening a file given the evidence. So what got him charged and sanctioned in one state was innocuous to another
