VA input request re: missing porch railing

FHA and VA do not require updating to current code which would require pickets that will not allow a 4 inch ball to pass between the rails. That said, they both expect the appraiser to report potential safety hazards. Looks hazardous to me. FWIW, the 4 inch ball requirement is for infants sticking their heads between the pickets and falling down and choking themselves between the pickets or falling through all the way to the ground.
 
What Rex said. I suppose you could argue that the space is wide enough for a mother-in-law to get through and choke, thus off-setting the negative with a positive.

I think it makes sense to note there is a potential fall hazard and include this specific pic. My dilema is "subject to" or "as is"...

Neither...I would use CB4. EA that is doesn't need repair, per the client saying so. You showed the hazard, now it's on the lender to make that call.
 
what does CB4 and EA mean ??? :shrug:
 
Sorry...in reconciliation, there are 4 check boxes (aka CB) The 4th CB deals with Extraordinary Assumption (aka EA)

How did you get to "per the client saying so"
 
It is based upon you saying a professional inspection is needed to make that call. The client doesn't have to do that...it's their call. They can look at it and say "it's ok" and lend the money. Now it is them saying "it's ok", not you. You made the safety concern clear and said "I'll pass this on the EA that a professional (in this arena that I'm not a professional in), says it's safe".
 
That one looks like a fight between safety and aesthetics. For VA, it has a good chance of being waived if the buyer/owner doesn't want to obstruct their view.
