Emails/texts/calls that go unanswered by the agent show a failure to provide ordinary and necessary duty of care.They are sometimes that stupid - especially texting... The board came down on 2 Realtors in Chicago for something similar recently I believe- Appraiser Christopher Posey...
The agent is concerned about not receiving a commission, commonly expressed as “protecting my client”, and is not a defense in this instance. It’s no different than the agent not allowing a pest inspector access because “that guy finds every flaw. “
