It is your business decision on how to proceed with any new assignment with this client. My market in SW Florida is considered a declining market. OFHEO's HPI for the first quarter of 2008 reports a 12 month Housing Price decline of 17.45% for SFRs. I would not be inclined to offer a retrospective report at this time for the local market. Your market should aid in determining how you would proceed.

If my memory holds correct Governor Arnold "S" signed into law October 2007 Senate Bill 223. Article 7. Unlawful Influence of Appraisers may warrant a review.
 
I have a bit of a different view on this. I think sometimes we get so caught up in our own terminology which we try to force on our clients, who frankly couldnt care less. Why not just say, not a problem, I can convert it to a conventional appraisal for you. Do you want the same date or would you like me to do it now considering any new or additional sales that have occurred in the mean time?
You have just developed a scope of work with them, put that in your report, and complete the NEW ASSIGNMENT accordingly. Charge as you see fit.
Continuing to argue with our clients over the minute details is not serving us or them well. You know what you have to do .. just tell your client, dont worry I know how to handle it and then handle it. Problem solved.

What a great idea.
