FTR, A state not only can increase requirements, but also decrease requirements of USPAP. Even better, they can abolish USPAP altogether.

Does anyone doubt I am a states rights type?
I am not "type," but I tell you something a state cannot do - unilaterally create enforeable regulations for federal transactions. If an NC bureaucrat wants to go over to Fort Bragg and tell someone what they can do, he'll be in handcuffs sooner than later.

I did not say that in my post.

I understood that USPAP was voluntary, am I wrong? I understand Florida is oneof those that anyone can appraise as long as it is not a federal transaction.

Carnivore .. that certainly doesnt hold true in all states. In NM the state law has adopted USPAP as the law with additional provisions required by the state. No appraisals of property are allowed in our state without the appraiser being licensed (at one of various levels) AND meeting all USPAP requirements.

Do they mean the Fed Transactions as well?

not true...ask how they treat mineral rights. personal property. business property .... surface real estate...maybe. The law of unintended consequences gives rise to the problem of a host of 'regulated' enterprise being ignored.
 
Because USPAP requires a signed certification with all appraisal reports.
DUH! BUT IF THE DRAFT AIN'T SIGNED HOW DO YOU GET THE BLAME FOR IT???????????????????????????????????????????? Who is going to be able to tie YOUR NAME to THAT DOCUMENT? especially if 2 weeks later that document (a single page of numbers) is part of a 600 page report? And then all you have to plead is that the possessor of that page has only got part of the report. If you have fulfilled Std 1 and have a workfile with the info, then a summary page sans all other pages is a moot issue

Man, in FL, you practically need a license to breath.

But, it's a good thing you don't; we would all die first.

The client signs an affadavit. Is that your end run around USPAP? Don't sign the appraisal report and make believe it isn't yours? Is that legal?

I actually think this whole discussion has been really interesting. There are some very real challenges in trying to balance the need for flexibility in work product with the very formal, legalistic reading of USPAP taken by many individuals and State Boards.
