North Carolina Appraiser Background Check Law Passes

Let's suppose I owned a national appraisal firm, Trice Appraisal. I order background checks on my employees. Big Bank now wants all of their AMCs to require background checks. Do their AMCs call me for a copy. Do they call NC and ask them for a copy? You do realize the absurdity of this request, right? I think I understand what they are trying to get at but it is seriously flawed.

On another note the State appraisal agencies must realize that they regulate both appraisers and AMCs now. They are not advocacy groups for either of those stakeholders. Some believe that State appraisal agencies are advocates for appraisers. That perception is incorrect. Do some behave in this manor? Yes. That will come back to bite them.

From what I understand the SC state coalition worked hard for this, and other state coalitions are working for similar if not identical legislation.

I can't say I'm enamored with the whole background check situation, but we're at the point where it isn't going away, thanks in no small part to the likes of Joan Trice claiming the appraiser profession has thousands of criminals in its ranks.

Another unintended consequence of Dodd-Frank (I'll admit I didn't see coming) is residential appraisers coming together in numbers I don't think anyone anticipated. We're not near the numbers we need to affectively lobby but we're headed there. Mostly due to the flat out horrible treatment residential appraisers receive from AMCs. Appraisers have finally had enough and are pushing back, and I'll add not stopping either. And this is happening at a time when most residential appraisers are swamped with work, that should be a sign to the AMC industry that they are killing the goose. But they don't care, just flat out don't. Most will just move on to the next company after their current one is done fleecing appraisers.

You make it sound as though appraisers suddenly got organized. I respectfully submit they did not. The market got very busy and they finally figured out they were now in a position to negotiate fees accordingly.The laws of simple supply and demand. Are there foolish appraisers selling themselves on the cheap still? Heck yes, and some are worth what they are getting paid. That is entirely why the focus on fee panel management came into being... not because Joan Trice said so. I only wish I was that powerful. You give me way too much credit. What I saw was regulations and guidance coming together that would mandate due diligence. And then there is just the operational side as well. Really bad appraisals produced by knucklehead appraisers cost a bank a whole lot of money in repurchase demands.

So today everyone is working towards a system where the parties ordering appraisals are being held accountable as well as the appraiser. That is never a bad thing for honest, competent appraisers. It is that subset who I care about.

This is a discussion for APPRAISERS. You have no input, and as an industry, WE need to discuss this regulation with each other, and not be side tracked by your silliness.

Don't you have some whiny phone calls to make?

What's absurd and flawed is your constant spin. The law is simple, if a lender doesn't like it because their AMC can't deliver what they want the lender is free to form their own panel and not be subject to the law.

Still bent about what happened to your good friend Coester? Joan if you would have filed a FOI request and read the investigator's notes and findings you would know Coester got off with a slap on the wrist.

But back to your claim of advocacy, stop being a hypocrite. You love to crow about how many people you visit with and talk to while promoting your business interests and lobbying for AMCs, stop complaining about appraisers getting together to lobby and advocate for appraisers. There's absolutely nothing wrong with appraisers finally waking up and lobbying for themselves and against you and your friends.

I don't think appraisers are employees of AMCs unless of course they are W2 employees. I am not sure where you got that idea. Appraisers should lobby. They are pretty poorly represented as a group, for certain. Just my general observation.... appraisers don't want to belong to any group. State coalitions are plagued by apathy too. Some are fairly robust but most are not. That is too bad.

Appraisers should lobby.
Then why are you bent about this law? Appraisers lobbied and got something done, something they were forced to do by AMCs.
State coalitions are plagued by apathy too.
