North Carolina Appraiser Background Check Law Passes

Dennis well said..... I think a lot of folks are reading stuff into this that just isn't there. The 5 year rule seems rational for a statute of limitations. But to expect anyone to be forced by law to violate YOUR privacy is absurd and unenforceable.
I don't understand you or Denis. Five years is great on limitations. Also, the State is not requiring me to get a background check. I can do that if I choose to for a client if they want one. Turnabout is fair play I probably will require them to provide a background check on their principal and officers. Then again I might also want a credit check also. I do chose who I do business with.
 
It is a good 1st step for appraisers relative to background checks being performed by states. The 5 year limitation is very good too for appraisers. Relative to background checks being performed by states (which they will contract with somebody), it is a good 1st step in the right direction in my humble opinion. This definitely appears to be a pro-appraiser/lender bill imho.

The centralized location of being able to use state BC checks, if they choose to run them, is good for LENDERS too.

What the heck is this ambiguous sentence supposed to mean?

The State of NC is very Pro Small business. The current Government is controlled by the Republicans in State House, State Senate and Governor. Pat McCrory is Pro Business big and small. Employed people are happy people should be our Motto!

I agree. Criminally minded and Lawless appraisers need to be kicked to the curb. Plus hand slapping needs to be moved up a notch to suspension or revocation for violations that are serious in nature and where the appraiser should have learned on day one in Ethics portion of pre-licensing.

WE in the grand scheme of things are so insignificant when considering the overall industry we are involved with. Should be modified to read;

That's right. Many law breakers need to be prosecuted. Maybe states are raising the bar in prosecuting lawless people all the way around.

It's typical Joan Trice spin. The irony of this is Joan loves Dodd-Frank regulation (when it works for her), well here it is in action. States have been mandated by the feds to regulate AMCs, now here we are. Despite what Joan says the state isn't forcing AMCs to violate an appraiser's privacy, and as far as whether or not the state can force this on lenders isn't the issue and they aren't trying too. If a lender has a problem with what an AMC can and can't do under the law that's between the lender and the AMC. If the lender doesn't like having to run their assignments through an AMC because of this law then the lender is free to form their own panel and jump over the law. It's a business decision on the part of a lender, goose meet gander.

What I find to be absolutely ludicrous is that these Lenders, while crowing their concern about the Appraisers credibility and criminal history have themselves been committing fraud, been found guilty of criminal negligence, sued for malfeasance, along with a laundry list of other egregious violations.. have been illegally foreclosing on the same homes they send us too appraise.

With all the very pervasive lawsuits across the country, aside from hefty fines, does anyone know of cases where these bully gorilla offenders have had their state licenses to lend or conduct other banking business suspended or revoked.

The hypocrisy is epic and comedic.
