No one ever said that. I said the Constitution gives you the right to equal protection of the law as far as Federal legislation is concerned. In other words, to be treated by a Federal agency the way they treat similarly situated people in other states.
Ok .. what if they came in and said after October 1, 2008, all FHA appraisers must be certified in all states ... end of the equal protection argument. Next --
That would be legal and constitutional. What they are doing now is not.
For the government to set different grace periods for different states is not illegal or un-Constitutional. FHA Appraisers are state licensed. They can’t cross state lines. If the government set different grace periods within the state, that would be illegal.
I am located in Georgia. If the government says that appraisers in Florida have six more months than I do to upgrade to Certified, it does not affect my competition or me. Those appraisers can’t perform appraisals in my market area. However, if the government said that they are going to break up Georgia into regions and each region will have a different grace period to upgrade. This would be illegal. Because after my grace period is up, licensed appraisers who have more time could perform appraisals in my market area. But, this is not what the government is doing.
They are simply upgrading the requirement to perform FHA appraisals. They are probably going to give different states different grace periods to upgrade based on the structure of license expiration within that state.
Again, it is not illegal to require a higher license, more education, etc.

No, FHA approval is buy state. It is not a national approval.Why couldnt a licensed appraiser in one state get a temporary practice permit in an adjoining state. If he was on the roster,couldnt he appraise in either state?
