Thats the problem. These same people whine all day about full fees and AMC's, yet when "Its just how it is." is the status of the business, they cry like babies.

The question was answered within page 1 The thread DID go off key, This will happen from time to time thanks for pointing it out, BUT for myself due to so many NEW ones in the "Profession" some simple basic COMMON SENSE has to be DRILLED into SOME!!

There is nothing wrong with new people in this profession. That is one of the benefits of this forum. My favorite high school teacher once said, "The only stupid question is the one not asked", so maybe the newer members of the profession should be cut some slack. We were all new at some time, and no one knows it all.

"This will happen from time to time" is no excuse for not having manners.

Should'nt that be where common sense starts?

The thing that's kept me coming back to appraisers forum for more than 4 years is that in addition to be very educational it's also very entertaining. If it was nothing but dry lectures and "professional" disucssion I would have left it long ago.

What the Ethics Rule actually says.

The payment of undisclosed fees, commissions, or things of value in connection with the procurement of an assignment is unethical.

Now that sounds like, and I believe it was intended to say, that you cannot pay undisclosed monies to someone else so they will give you an assignment. You cannot pay an undisclosed fee to an AMC to give you assignments in your area. (Wonder how many appraisers violate that one?)

But, the Ethics Rule seems to be mostly silent on the appraisers receipt of undisclosed fees, commissions, or things of value. This might be a good place for a re-write for clarity, because it is clear to me that accepting a "tip" would be unethical.

The use of the term "in connection with" seems to mean it works both ways ... paying or receiving.

That could be... however, the word "procurement" seems to limit it to getting the assignment for payment of a fee or commission. Regardless, it could certainly use some more succinct language.

Bobby .. this is a bit off topic but you said something above that struck me and I have bolded it. It seems in many instances we do everything we can to keep new people out of our profession and many new that do come in work for a sweat shop and never learn. I would like to see three major changes to our profession ...

1) If you have trainees you have to have special coursework and pass it.

2) If you review .. you have to have special coursework, pass it, and hold a higher certification to allow you to review others work.

3) I would like to see ONE FORM that is 100% USPAP compliant that is used for EVERY residential assignment no matter who the client is or the purpose of the assignment.

I welcome new people into our business ... they just need to be trained right. And asking the question about taking a TIP is something everyone of us has encountered. I applaud the poster for doing the right thing and asking because they did not know.
Shame on all of you that made light of this persons question. It was serious.
