Help I Am Being Screwed By The VA Dpor!

Find out the names of attorneys who have appeared before state boards and commissions (in particular, appraisal or real estate). This is not difficult to do. The attorney must be well versed in administrative law. You are not a defendant as you have not be charged with anything. You are a plaintive, in effect seeking action by the board.to correct what you believe is a wrongful decision on their port. Your board must comply with AQB requirements, their obligation is to them....not to you. TAF sets the MINIMUM standards. State boards can't change or reduce the MINIMUM requirements.

Just call everyone who got licensed/certified in the last couple years - can't be that many

Better yet, search the ASC.gov site for appraisers who have become INACTIVE in the last month or so (like you) ...a much shorter list.

I have a strong feeling you are not the only one that is being reversed due to states not complying with federal deadlines. Try to find out others if if there is any way and see if they have gained any help and how. I don't know how you do that though. No clue.

Thank you all for the helpful advice.
My license is still active as must be those who are going what I am going through in the state of Virginia at least. Our IFF hearing is Jan. 13th, but I can try to search out of state inactive licenses? How do I find attorneys that have appeared before the state board, is there a public record? I have tried all kinds of internet inqueries and have not found the right search yet.

Why is your license still active if the board has already sent you a letter saying you did not meet the deadline and a mistake had been made? Go to ASC.gov and search for recently inactive licenses in your state. This may not work because if I understand none of the licenses will become inactive until 01/01/2016 when the new changes take effect. Ask the board attorney or executive director about a list of lawyers who have appeared before the board or request meeting minutes or look at disciplinary actions and see who actually had a hearing (perhaps in a newsletter or online at board website). Contact some of the appraiser organizations in VA and see if they have some leads. Try to postpone your hearing.....chances are you will not find and be able to meet/prepare with a lawyer so soon. Good luck.

I know the minutes for board discipline hearings in Arizona will mention if the appraiser has an attorney, and will occasionally mention the attorney by name. Are the minutes for the Virginia board posted on their website? I was certified just a few months before the deadline, so I know how much work you went through. Good luck.

If the board allows the license to remain as is, does it not open the door for others to say, "if I had known there was a time period beyond that made known I could have obtained my license as well?"

If in fact the direction from the board is in writing, it still is up to the Appraiser to know and understand the law/regulation they are to abide by?

I hope it all works out for the OP, but this can, possibly, take the lid all the way off of the can or worms it appears DPOR has opened.

This will be a very interesting decision the board has to make, provided the situation is as presented.

I see what you are saying, however the information about deadlines was given to me directly by a member of the DPOR on the Appraisal Board, who directly approves appraisal licensure. He said I had to have all the requirements fulfilled and just be approved to sit for the exam before Jan. 1st, 2015. I assumed the information to be correct, being that he was an authority on the subject.

I suppose my license is still active until the IFF hearing where I am given a chance to show I have fulfilled my obligations. I did search for recently inactive licenses in VA and found none. When I expanded the search to include all states, there were hundreds, but it seemed that many of them had just transferred to another state. I will try your other suggestions, and the link you gave to the lawyers is very helpful, thank you!!
