Judge Rules Appraiser/Lender Owe no duty of care

With respect, "I don't know for sure and I have no evidence" is a far cry from proving an allegation of fraud.
I said no such thing. I said I know why multiple items that would've required it be subject to were concealed. Thats obvious.

I said the appraiser refused to provide the evidence to prove it when asked for which speaks volumes.
 
People here do not defend incompetence. We know full well about Class AMC and how they prefer the most incompetent appraisers that they can pay pennies to keep sometimes 80%+ of the appraiser fee.
I ask for at least $650 appraisal fee for FHA appraisals for additional work and risks.
Can't imagine that appraiser getting so little for all the problems she is facing now.
 
There are legitimate reasons for the status quo, and those reasons have nothing to do with appraisers covering for the lenders, covering for each other or tolerating misconduct. Half of appraisers hate their own clients and hate their own peers. You have had a couple of them in this thread who have deliberately fed into your anger in furtherance of their grievances about their shrinking business interests. .

You have a legal problem, not an appraiser conspiracy problem. You wanted to get at the appraiser but the judge ruled otherwise. Possibly in accord with an existing precedent (although that's a question for the lawyers to answer). Sorry for your loss.

Again, Incompetence does not mean anything was concealed even if implied nor that I approve of overlooking incompetence. But proving 'intent' is a much higher bar than pointing out incompetence.
 
In response to an acre not being large enough to meet the guidelines. That makes no sense. No way that is true.
Tiffany, the replacement plans for my property only has room for the septic to be 66ft from the well. FHA does not allow less than 75.
