Judge Rules Appraiser/Lender Owe no duty of care

irrelative to problem at hand for this person.
We need to see the circumstances in how she bought the property and what due diligence she did.
Not fair that when things go bad, she goes after the lender and appraiser when appraisal was for loan purposes. If appraiser made a bad call, then it's lender's problem.
 
You never mentioned buyer's agent. Were you the buyer's agent?
I represent myself when I buy properties and I admit, I forget to do my due diligence.
When I wear my appraiser hat, I'm more objective.
Representing myself, I make mistakes and the emotional aspect of the buying makes me drop my guard.
 
If the appraisal report did mention all the accusations, the original poster would blame the appraiser for causing loan denial.
That certainly justifies their (appraiser's) actions!
What I meant was this thread would be different. No matter who was right or who was wrong, she will some how be a victim.

Single mother works for years to buy dream home to find out three months later the septic inspection/cleaning company failed, blames FHA and the appraiser.

Instead it would read:

Single mother works for years to buy dream home but gets denied loan because FHA and the appraiser say the septic does not meet standards even though it was inspected and cleaned.

This. Tldr it sounds like the judge made a good ruling based on the information I have seen. Appraisal was for lending decision,op got their loan.
 
It was not an all cash offer nor a conventional loan. The home did not qualify for the loan and we are on the 87th page of appraisers still attempting to deflect blame with hypotheticals.
You have deflected blame for your own decisions. You applied for a loan and got one. Now you want someone to blame because of a lack of your due diligence or unexpected problems.

Which means your belief is there should be no consequences to incompetence.
 
You have deflected blame for your own decisions. You applied for a loan and got one. Now you want someone to blame because of a lack of your due diligence or unexpected problems.
I have stated facts and the only entities REQUIRED to determine those facts were the appraiser/lender NOT the buyer so unless you can show me where the buyer is required to determine the property meets all FHA MPR you are DEFLECTING appraiser responsibilities to the buyer.

Asked and answered repeatedly. You just don't like the answer. The appraiser is being held accountable by their client and users. The judge has ruled against you are not among those users.

That is not what was said. I said due to the prior transaction being an estate sale the systems location was not disclosed to the seller nor was it on the survey aka records.

What question about the leachfield failure? If you're looking for a reason why it failed no one knows.
What I asked was if the problem was that the leachfield failed. Later on I asked if you killed the leachfield. Asked, not assumed.

I do appreciate you finally breadcrumbing that piece of info for us, though. 200 pages after I asked you.
