While agreeing that ASB cannot impose USPAP requirements on anyone other than appraisers;

IF portals send something other than a true copy of the original report

and USPAP has been adopted into state law (meaning USPAP has become law), how do portals not deal with:

particularly in light of SS's comment of "Then the client moves on to someone else who solves their problem".? :shrug:
 
Mike I must say that on ethics and substance you’re in the lead in this debate. In emotion and shrillness I’m afraid Steven and his groupies have an insurmountable lead. :)

Really, I think Communication Breakdown would be more appropriate? We all want the same thing, just can't agree on where the problem is or how to fix it.

Ah, the heck with it. Turn it all over to the computers. That way they can be programmed exactly the way the "authorities" require. No need to worry about ethics or judgement. No need to worry about portals or voodoo software. No bad attitudes or concerns about the price of gas or Skippy. Just run a nice statistical analysis and get a number. That's all anyone needs anyhow.

The good news is its too far off to worry about (30-50+ years). Heck, it is likely they will have tiny sensors scattered throughout structures than can sense moisture, stress, etc., and the sensors will be tied into such a massive Ultra Large Scale System.

Appraiser will surely be needed to monitor and manage these systems - which may even someday include "Mr. Inspector" class robots with infra red vision, etc..

How can the ASB (or any of the states) endorse one commercial softare program over all others?

That is not what I said. I was not speaking about the generally used commercial form filling appraisal software on the market. Such as; Bradford, a la mode, Day One, etc.... I was specifically speaking about web portals and conversion programs like AIReady and Lighthouse that take our written reports, after we are all done with them, and convert them to something other than what we created.

These companies coming up with this stuff are doing so to make profits they absolutely do not share with real estate appraisers. Well it should then be THEIR expense to prove to appraisal or banking regulators they are not causing misleading appraisal reports. Not each and every individual appraiser in this nation to do so as the ASB just stated it is. The ASB just created a cut off point of responsibility. I am saying it was the ASB that just created the wrong cut off point.

If our industry is not going to have WYSIWIG on our computer screens showing us our reports, as we created them, that is a problem. Appraisers are not, and should not, be held responsible when we are ready, willing, and able, to transmit exactly what we created. Not something we did not create and is being manipulated after we get all done with Standard Two and are ready to have for our work file what we did create. Only under pressure to comply with allowing that work to be ripped asunder so others can make more money, we are now responsible for that prostituted version we never wanted to send in the first place.

Sorry, the ASB should have said if we all ask to upload what it is we created for the client... but the client says... "no, no, no, I just want the piece of crap that results from this conversion module I am going to force you to use or not send you any more work...." that the appraiser should be off the hook right then and there when that client is a professional user of appraisal services. It's these professional mortgage clients that are causing the problem, they should get 100% of the responsibility then. All the appraiser should have to show any board is the report the way the appraiser created it, converted it to a PDF, and had available for the client if the stupid client had of wanted it. End of the appraiser's responsibility. It should be dumped right back on these mortgage lenders to wonder if what the appraiser created and what they got was the same thing. Not dumped on the appraisers to prove that after they create something that some demanded conversion program did not cause it to become misleading.

The party demanding the conversion should take responsibility for what that conversion does when that party is a mortgage lender or third party company the mortgage lender allowed to be involved in the demands.
