Now I know why lawyers ger $200 an hour....it takes them that long to say......"no, you can't win if you sue!".

It's so nice to have someone post who has something intelligent to say and not just a knee jerk reaction. Kudos to you.
 
Ladies and gentlemen of the jury ah forum ah what the heck.

Pam you posted this thread all excited that some lender is exposing appraisers on their site.

The administartor of the site says, oh we put the names of appraisers we have had problems with. Not violations, but problems. He went on to say we rarely if ever file complaints.

Sue, what would be the point we look at burden of proof, possible damages etc. and not be worth the effort.

My point is and will always be, why would I, regardless of how clean I am, do work for a company that would post on a public forum a list of "appraisers we have had problems with". Did any of you take the time to read this site? Did you read the application to become a broker?

I have never seen this forum so turned on as they have been in the past week, with little digs like "I see two guys from our area that are on the list and they deserve it". Who are you or anyone else to judge these people when the reviewers let these people slide, the states blow it off and every other lender on the street commits fraud as matter of daily work.

I think it's a little sad, evryone is so concerned with the changes taking place in our industry and you find glee in the possibility that list like this exist but wait until your name goes on it. I gurantee if you do good work, you do work for them and when you don't hit the number or jump the hoop, your name will be there for all to see.

That's true, but, on the other hand, I know who is good in my area. I also know who will deliver any value they are asked to. I don't do many reviews, so I don't often have a chance to turn the bad ones in; but, I wouldn't hesitate.

I'll stick with what I said before. I don't think it is too smart of these people to do this, but what the heck....

I've said before, there's a huge time commitment to turning in a bad appraiser to the board, state, etc.

Ideally, the client would turn the guy in. But they do what you would do too if you just want to make loans and make lots of them when the market is glowing red hot. You cross the appraiser off the list and don't pay him. He'll go away -- quickly.

The lender isn't interested in investing their profits in chastising the appraiser. Just like the office girl who returns from lunch drunk -- she's outta there!

Then again, on reviews, the client often is attempting to get the appraisal trashed so they don't have to make the loan. Flip side of the coin. They might hassle the Reviewier to get what they want.

In the interest of being difficult, I truly enjoy a challenge, so when the many attempts to sully my name by endless numbers of poor Reviewers, I have turned the table in many instances on them. You do have the right to defend yourself and your work to the best of your ability. This fact also includes, not only turning in the Reviewer to the State Board, but also the Lender for hiring an incompetent (if thats the case) to review your work. So, for those who have not ever felt the need to defend yourself, welcome to "The List" - hey anything good, takes lots of time to save and is well worth the Effort; on the other hand, crap isn't worth the attempt to defend and thus consumes very little time.
