Yes they even have a right to order a useless one but I guess useless is in the eye of the beholder.

Oh boy ... You think a state's role is to design private business' business plans? Why don't they just do the appraisals and eliminate appraisers. You do realize the NC hires a vendor to do their background checks right?

Companies that want to do business in states modify their business plans and policies to be in compliance with state regulations and laws. Otherwise, they take their business else where and don't do business in the state. Not only do states regulate, they are duly authorized to make public policy. Health, environment, police powers, taxation, to name a few, as well as professional licensing laws. Golly gee, they are even regulating private business such as AMCs now! The audacity!

But go ahead, consult with your lawyer and tell the states they cant or don't have any authority. Write a white paper, a few buzz interviews might also do the trick.

Plain and simple - desperate grasping for straws. You know darned well that FCR Act was initiated and made law to regulate the shoddy, dishonest business practices pertaining to Lenders, Creditors, BC check companies and other financial minions of Hades.
 
I don't know Denis. It is rather weird. Some AMCs order their own. I don't see how they can demand they not. Some lenders have very specific requirements.

It seems to me that the NC Regulation would be conducive to a "central clearing house" type of operation.
Unless the states (who I believe are required to institute BC checks; as my regulator has done since licensing-inception) allow the appraiser to opt-into a "background-check share" program, then this is where we are headed. And, even the states don't do annualized BC checks.

I'd say this is a positive for BC companies in terms of ensconcement and market-share for appraisers. Of course, I said the same thing about HVCC and Dodd-Frank in regard to AMCs (and I was right).

And before anyone gets on their high-horse, I'm making an observation. Not a judgment.

You are allowed to make an observation,

But that would require something you actually can observe.

Otherwise, it's an opinion of what "might be".

None the less, I did not see anywhere that NC did not say it may provide annual background checks, especially since the F/D says that states "should" background check appraisers.

I designed CBX entirely so an appraiser could order one and share it!
You forgot to add all of the other things your user agreement allows, like when you used your x-file database/background check without the lender's or appraisers' permission in an effort to sell your product to the lender.
But do I think they need a law stating that? No.
Yes, we're at the point states must protect their citizens from people like you by passing laws to regulate your business.
