Correction: Consistent LACK Of Enforcement Task Force?

-NCAB attorney, Roberta Ouellette, who is also a member of the Appraisal Foundation’s Consistent Enforcement Task Force, presented the Board with an exposure draft of the "Voluntary Disciplinary Action Matrix” being developed for adoption by State Appraiser Regulatory Agencies when enforcing USPAP. Since the NCAB is recognized as one of the leading appraisal enforcement agencies in the country, most of the notes and
application examples were developed by Ms. Ouellette.

This sounds like some sort of cruel joke on appraisers: Roberta Oullette a member of any part of the Appraisal Foundation? What is she developing, a new list of excuses to let repeat violators off? That would be consistent for her.

He then testified that his computer had crashed and was told by two different repair shops that the computer could not be fixed. He also testified that his father had become sick with cancer during the time that these appraisals had been completed and he had also separated from his wife and was on anti-depression medication. He had been diagnosed with severe depression. He also testified that he could not remember much during this time period and that he had actually been sleeping in his car for periods of time.​

I did not say that HE did not show up for HIS his hearing. My statement referred to revocations in general....not specific to this guy.

I have no problem with a standard policy of revocation for those that fail to show up for their hearing. It takes months and sometimes years for a complaint to ever reach a board hearing. Hearings are rare. Any appraiser scheduled for a hearing has had adequate notice (as required by law) and in some cases have been allowed a postponement (or 2...or more).

Hearings go forward with or without the accused in attendance. I would venture to guess that 100% of those revoked in the last 10 years were offered a chance to accept a Voluntary Surrender" rather than face a hearing.
The smart ones took the deal and the dumb ones were revoked.

Fifteen revocations of licensed and/or certified appraisers in 20 years at the NCAB (per the ASC). Very few even bothered to show up.


Any luck with that board seat yet? Better get your check book out....oh yeah...no checks anymore...cash only...small bills.
