That's a fact... any one of us could possibly wind up on the list... you are only as good as your last appraisal and anyone can make a mistake. The last perfect man died more than 2,000 years ago! That being said, I have a feeling that most people on the list deserve to be there... and there are likely many more who are not on the list that probably should be. The thread is a helpful reminder.

Any one of us could be next, seriously. You make this thread appear to be a gossip column, however you admit the information is also public record. :shrug:

Mike Kennedy does us a great service! We all have to be mindful of this. How dare you :nono: to him.

You know, I dislike this thread. I dislike that Mike Kennedy feels the need to be the official tattle tale, but it's just as bad to sit around and say, "Gee, I wonder what that guy did..."

There's a place where you can look up all this info--ASC.gov ... and there's a place you can look up old timer, John Murphy, on your state's site, and since it's a closed case, you can read about it. Or you could ask Mike to post the contents here...

The gossip in you will likely be disappointed, however ... there's nothing sexy in that file.

I'd be curious to know whether most appraisers find this thread useful or annoying....

Actually, that is a fact. Most people don't realize the capriciousness of government and the tendency of many with prosecutorial responsibilities to assume beyond reasonableness that someone brought to their attention must be guilty. That is why it is so important to keep in touch with your Board, to know those personalities and understand their point of view. That is also why it is important to stay in touch with your reps in government to help ensure that good people get into those positions in the first place.

Two primary ways you, a good appraiser, could wind up on the list:

1) Lapse in judgment.

2) Outright error.

I still believe that most on the list belong there. That most of them are unethical people who milked the system until they got caught. But, I'd be willing to bet that a substantial number were otherwise good appraisers who fit into one of the two categories above.

Mike does us a good service by posting this reminder... most of us, myself included, would be too lazy to go look it up all the time. It is important for us to know how active the authorities are and to find out what we can about the violations that led to the discipline.
 
You can get the very same ASC email that is posted here.....for free. That way if you don't like this thread you won't have to read it.

The ASC disciplinary actions serves many purposes. To alert the public, all state boards, E & O carriers, banks and nation lenders. The daily report also shows us trends in renewals and most importantly serves a cold hard evidence that some states actually enforce appraisal regulation.

There Should Be A Process If An Honest Mistake Is Made(not Fraud) That One Could Redeem His Lic. Perhaps Two Strikes And You Are Out.

An Appraiser Told Me He Had Many Good Appraisals In His File But One Or Two Put Him Out Of Business.

Putting Out Of Business Is A Serious Situation.

I have been around a little while now and my experience is that an honest competent appraiser has nothing to fear except reprisal or politics. These are really very rare and difficult to pull off without great risk to the person who is 'stickin it' to someone. Remember these boards are made up of a number of members. TO be attacked by all of them would mean you really have some other problems that the general public is unaware of.

Frankly, I think most if not all appraisal boards bend over backwards to keep people licensed. Its all revolves around the Plantation Theory. In part the theory is one with a goal to have large numbers of cheap unorganized minimally skilled labor(most residential appraisers).

Having said that I do understand that people make mistakes. I am having a hard time thinking we should call off boards because innocent appraisers are being denied due process. Some strong evidence that the boards are way to lean is the fee level across the nation for SFR appraisal reports. If there was higher risk then fees would be higher.

Some are going to argue with me that supply and demand is why fees are low. Yes, supply is the problem, only because the supply is artificially high due to lax enforcement and low standards of performance expectations by the appraisal boards and lenders who dont file complaints or fire Skippy.
