He needs to hire an attorney to have it worded properly. Especially since he's accusing groups of price fixing, collusion and restraint of trade. As it is, the petition sounds amatuerish and whiney, and I don't think Congress would pay much attention to it.
 
In my opinion, the best thing that could happen is that banks own the AMCs. Of course, this requires that current existing banking regulations be enforced.

This would eliminate what some banks may think of as a "buffer" between their regulatory responsibilities of maintaining appraiser independence and hiring a third-party vendor to manage the process. This regulatory responsibility cannot be "off-loaded" to a third party vendor. The authority to conduct appraisal management can be off-loaded, but the ultimate responsibility of maintaining regulatory compliance remains with the FRTs.

In fact, with the appropriate level of existing regulatory enforcement, the only reason for a bank to have a separate AMC would be for tax purposes. The actual regulatory responsibility would result in business practices to be the same as if the bank were using their own internal appraisal department.

(But no one is nominating me to head the FRB, OTS, FDIC or NCUA yet! :laugh: )
 
Why not just abolish free enterprise and regulate everything? :Eyecrazy:

I just think the wording needs to be clear, everyone needs to be aware of what they are signing before they do so. Putting something that is not crystal clear out there will do more harm than good.

Right on, Wayne!!! :clapping: Petition this, petition that. Geesh! I don't even know what this guy wants to accomplish. Ban all AMCs? For what purpose? I work for one AMC who's very good, pays my fee (on time, no less!), and is very professional and good to work with. If you don't like who you're working for, the answer is simple. GET BETTER CLIENTS!!! Free market, ya know?!

AMC's will always be out there. Make a buck off of someone else's back. I was a banker once, the AMC sales rep. would come into the office with Bagels and Cream Cheeze, (a New York thing) smile and say. "We only use the best appraisers, all work is done in 48 hours and reviewed by our QC department, AND we can do it for $$$ amount, saving, you time, money and underwriting expence".... Crock of sh*%.
They will hire "skippy's" who will work for less, and have no work, so they can give 48 hour turn time. Pam Crowley, I know where you are, been their twice. EVIDENCE is key. I have saved every email from every banker/broker in the past 2 years that was "grey area fraud". NYS Atty General's Office has copies as well as voice recordings of personal/professional threats.
The AMC's, after I quote my fees, come back with...."Your fees are over the acceptable range" or "your fees are beyond the anticipated for your market".
Of course they are trying to manipulate fees. I only wished I had kept copies of email from AMC's rejecting me for my fees.
