It's incredible how shady companies are. Last month my friend was working 60+ hours to cover for a strike, and he was specifically told by management that overtime didn't apply. I showed him the wage laws and he just shrugged. I doubt he got paid overtime.

No, he is not salaried and DOL documents show that his specific job cannot be classified exempt. He stocks store shelves with liquor. Merchandising. Paid by the hour.

But this happens all the time. I know someone who works very high-level sales. We have had arguments about how independent contractors can be treated. It's astonishingly clear that they treat their independent contractors like employees (not giving them freedom to accept/decline work).
