Help Needed - State Denying License Upgrade

let this be a lesson to everyone - whenever sending in anything to the state, and that includes my annual renewals, ALWAYS send it certified mail with a signature required.

The state of Virginia is sophisticated enough to allow you to do it on line. Very simple.(For renewal).

The USPS has a service where you can send through them with a tracking receipt. Same as certified.

yep, i've used the USPS tracking as well (it comes free now on all first class mailings) but imho it's not the same thing as sending signature required. the tracking just states it was delivered. the signature tells me who accepted it.

That *should* work, but, there are some agencies (Notably: Tax Service City of Philadelphia) who -at their whim- will circular file anything that will make them look bad.
I literally made 12 copies of a letter, complete with documentation, and sent it to every single Councilman that City has. One responded, and the problem disappeared.
The squeaky wheel gets the oil.
 
If you are being denied something worth 2 or 3 years of experience, I would go to a good attorney. Explain it to him and have him draft a letter with full documentation, and send it to the state board head.
 
A state board or commission has no fear of some attorney. The commission is represented by the state Attorney General and there large staff. It is a rare thing for a private attorney to win against the vast resources of the state Attorney general.

Have you had anything similar to this happen to you??? Because I have and when I showed up to the appraisal board with an attorney EVERYTHING was magically fixed within 30 minutes, after days of nothing being done.

No, but have been there for hearings and appraisers with lawyers never win. NC has a procedure to follow and a settlement is offered to anyone before their case would go to a hearing. To refuse a settlement and take it to a hearing infers that the investigator did not do their job and that the board attorney was unfair with the offer. Boards vary. Not even 5% of complaints in NC go to a hearing. Glad your case worked out.

Well first off, the OP is in Illinois, not NC, second this isn't a hearing, it is about them losing the documents and being incompetent, so there is not a "settlement" as this isn't a complaint from a homw owner, as I said, I had something similar to this happene to me in Texas, they made a misstake, I went down there to try to get it taken care of, the were not helping at all, I went back with my former boss's attorney and it was all taken care of in less than an hour.
 
I just looked at the IL trainee rules. Looks like their was a required fee to be submitted with the application. Should be pretty easy to prove the check was cashed. And if it was not cashed then the OP should probably have noticed that and looked into it a couple years ago.
 
Lee Lansford is the state board chair this year (I think) and Brian Weaver, licensing, participates on this forum. Contact them both.
 
Thank you all for the replies and advice. In hindsight, I certainly wish I would have sent the form through certified mail or at least called to verify it had been received. Surprisingly there was no fee for this particular application form so I am unable to prove it had been received thru that channel.

I plan on contacting Mr. Lansford and Mr. Weaver, as well as a local appraiser who is on the board to see what can be done. I am hopeful it can be reviewed and resolved without the need for an attorney - something that would seem to be an expensive last resort.
