DISCIPLINE NOTICES FROM Friday, December 17, 2004

FL RD0003297 - MANDERSCHI, STEPHAN - Suspension 10/29/2004

Mr. Mancerschied stipulated to a six month suspension, I believe. He was also fined, agreed to a probation and completing education. The DBPR had agreed to lesser penalties, which the FREAB rejected. Rather than drag this out, Mr. Mandershied and his attorney negotiated a new agreement which was accepted by the FREAB

FL RD0001851 - SCOTT, CHARLES - Suspension 09/16/2004

Can't find records for Mr. Scott

FL RD0003612 - VARGAS, CESAR - Suspension 10/20/2004

After an Informal Hearing, the FREAB suspended Mr. Vargas' Certified Residential License for 30 days, assessed a fine of $1,000, costs of $1,023. put him on probation for 12 months during which he must complete 15 hours of education and attend 3 meetings of the FREAB during which disciplinary cases are heard.

FL RD0001769 - ZAPPULLA, PAUL - Suspension 08/16/2004

There is no hearing on this, but Mr. Zappulla has a case pending. I believe this suspension is due to Mr. Zappulla not fully complying with the requirements of a Final Order which suspended his Certified Residential License for two years. Don't take that to the bank. I'm just nor sure.

Most of the time the ASC shows begining and ending dates of suspensions.

Would you find out why this is not done the same way EVERY time? Did Florida not supply the ending date to the ASC or did the ASC simply not report it?


This is no big deal....but if the LEGNTH of the suspension is not reported by the ASC ....it means very little.
 
The NCAB revoked another one last week. In fairness, I will wait until it comes out on the ASC website...rather than post the name now.
 
I applaud your Boards for mentioning names of the disreputes.

Here is a a section of the Queensland valuers registration Board 2003/2004 Annual Report >>> No names mentioned!

Complaints
Fifteen [15] new complaints were received in instances involving valuers. An independent
investigator was appointed under Section 44 of the Act to investigate two [2] of the complaints
against the valuers. No charges were made by the Investigators as a result of these
investigations.
Two disciplinary hearings were held arising from charges laid by the Investigator.
Advice was received by the Board that a person, who previously had his registration cancelled due
to disciplinary action, was holding himself out to be a registered valuer. This person was
successfully prosecuted through the Magistrates Court.
There are several complaints yet to be finalised.

I'll see what I can find for our other States!

I agree we should have more info about these suspensions/revocations. The title of this thread is, "Does Anyone Know What Happened?" We still don't know, it is apparently not published. Is what they did to merit a suspension/revocation a secret? Seems possible if the CO skippies and the CO enforcers knew more about these things going on elsewhere (ie. we find out and tell them) the CO skippies would see the light and CO enforcers would take heart. It might have some impact eventually on the public understanding and trust too.

I'd like to assume, as is implied in some of the posts, that the disciplinary actions are due to the plethora (learned that word watching "The Three Amigos") of breaches that we all talk about on AF everyday.

But wait-what if they got suspended for spending too much time complaining on AF? If so then-I'm next. Honestly, I've been thinking of joining those AFers who use fictitious names and empty profiles so some terrorist MB can't track me down so easily. Do you think the MBs and AMCs got these appraiser guys suspended after not paying them and black-balling them because they wouldn't "do comps"?

On second thought. My self-righteous side continues to choose the good hills to die on. This one looks good-for now. Fools do rush in ya see.

The details may well be published.....but not on the ASC website. Details will be released by the state appraisal board.


This posting (for the Florida guy) and all the others are from the ASC (Appraisal Subcommittee for those who don't care to know their alphabet soup). The ASC sends out a DAILY email (for free) to anyone who wants it which shows the suspensions, revocations and expirations for any appraiser on the National ASC Registry. This email always reflects an aprx. 30 day delay. Today's email shows activity for 12/02/2004.


This report does not give the WHY for disciplinary action....only the what. In most cases it will give the begining and ending dates for suspensions. The last several times I have noticed that in the case of a Florida suspension....it only gives a single date rather than a begining and an end.

The ASC does not publish the details or synopsis of the disciplinary action. In some cases the individual states publish the details on their website or in a newletter. In most if not all states the details are public record and you can get a copy of the action by the appraisal board if you want it. NC publishes all of the disciplinary actions in the quarterly Appraisereport newsletter. There will be a short paragraph or two on each case that resulted in disciplinary action. I have asked for and received greater detailed information from the NCAB several times.
It is all PUBLIC RECORD. Just last week I asked for and received a copy of a consent order in a particular case.


The ASC website has some great information. Every appraiser should go there and learn what info. is available and how to get it. You can even look up your state appraisal board and see what their "report card" from the ASC says.

I added 1 Hour to my USPAP Update class just to spend some time on the ASC, NCAB, NCCOB and other websites.
 
I'm going to 'guess' that the missing expiration dates for the FL suspensions are left missing because they also have additional CE classes to take and fines to pay before they can be re-instated. Some haven't done what they needed to do and won't be reinstated at the end of their suspension. It makes sense not to post the end date of the suspension under those circumstances.

Regarding the letter from the ASC to the FREAB that you posted the link to: FREAB is under the blanket of FREC (Florida Real Estate Commission) and has a 'Director' that covers both. The FREAB fought long and hard with a prior 'Director' regarding the lack of verifications that he got rid of before they knew he did that - plus many other 'little cost cutting measures' he took without consulting the Board. We all cheered when he was 'moved' within the state government and was no longer 'in charge' at FREAB. He alone did so much harm and it's taking a long time to undo what he did - most of which he did without the FREABs knowledge and it also took a lot of time to catch up with the changes he made. Once they found out about each change, they yelled loud and long to fix the messes he made as they found out about them.

Do you think it would help get this Skippy problem out in the open if I tracked down the CO appraiser disciplinary actions and publish the verbatim report (so I don't get into liable issue) on this forum?
