...I have not given my permission to FNC to use the data..

If you used a Fannie Mae form, then you gave permission for the report to be sent to data collection/reporting services - unless you modified the certification, which is not allowed :)
 
If I recall correctly, Metroscan (First America) gets their updates from assessors offices. This is public data but they do pay the assessors offices for the time and effort and inconvenience required to download. Since Metroscan is public data, should we be allowed to access this data free of charge? They will answer that they add value to the data by making it searchable. Doesn't an appraiser do the same thing that is add value to the data by interpreting it and presenting the data in an understandable format.
Is the Metroscan data public? Nope, they have added value. Is appraisal data public, nope, appraisers have added value if nothing else than they combine and verify the public data. This is acknowledged by FNC when they refer to appraisal data as the gold standard and refer to assessor data as something less. If it has been verified and checked by an appraiser, the data has become more valuable and should be paid for by a 'data miner" because they sell it as such.

Sending something may be seen as implicit approval to use it. It certainly is not expressed permission.

If you think it was expressed, maybe you can explain why they just did not come out and say it in more specific inarguable terms.
 
Mr Wiley,

I have been coerced by Fannie Mae to that on the very real threat of losing business. My point is that I have added value to data and cannot agree to data mining of RMLS data, Metroscan Data and other data because I do not own the data, I have permission to use not permission to sell. If FNC wants the data let them buy it.

You might want to check out the thread in the technology section about PDF viewers sometimes not showing the signature. Better yet, refer to your own post #1353 - the one where you said you could not view the PDF I had posted. :)

All software will have some issues, PDF for the overall picture seems to be the best solution as it is available to everyone. I beleive most of the issues have to do with folks trying to use version 4-8, when adobe is on version 9 now. It is part of the appraisers due dilligence to keep up their software.

Mr Wiley, are you getting a case of underwriteritis? :icon_mrgreen:

I said I couldn't SAVE the AIReady file but could save the pdf of your regular software file. I had no trouble viewing either one in pdf format. With some help from a forum member, I did finally manage to get the AIReady file saved, but had to do it differently than I saved your other file. If you recall, I said I wanted to SAVE them so I could compare them side by side when I could get them to my dual monitor set-up.

Because it is illogical to argue that permission to send a report to a data reporting service does not convery the right of the service to actually report the data.

I assumned it was something specific for fannie mae. I did not learn about (Eape,, FNC, etc)them re-selling my intellectual property for profit to other parties until several years later."

I have never had any problems with PDF. I have had the opportunity to compare my own appraisals to what my client received and they look just like the original PDF that i sent........I have also had the opportunity to view several other appraiser's reports delivered to thier clients in PDF that were sent to me for review and have been able to compare the product under review with what the appraiser has in their workfile...... they too were identical. How about that, a delivery system that works!:new_smile-l:
